              There is a section on it but it doesn't look like the pcn is there but it might just be a crap picture. I don't need to see it, just need to know if the evidenced it.

                  In response to the operator evidence i would like to add as follows :-

                  Theoperator has not shown that number 7 from the BPA CoP has beenfulfilled.



                  7Written authorisation of the landowner





                  Theoperator does not own nor have any interest or assignment of title ofthe land in question. As such, I do not believe that the operator hasthe necessary legal capacity to enter into a contract with a driverof a vehicle parking in the car park, or indeed to allege a breach ofcontract. Accordingly, I require sight of a full copy of the actualcontemporaneous, signed and dated site agreement/contract with thelandowner (and not just a signed slip of paper saying that itexists). Some parking companies have provided “witness statements”instead of the relevant contract. There is no proof whatsoever thatthe alleged signatory has ever seen the relevant contract, or, indeedis even an employee of the landowner. Nor would a witness statementshow whether there is a payment made from either party within theagreement/contract which would affect any 'loss' calculations. Norwould it show whether the contract includes the necessary authority,required by the BPA CoP, to specifically allow the operator to pursuethese charges in their own name as creditor in the Courts, and togrant them the standing/assignment of title to make contracts withdrivers.


                  InPOPLA case reference 1771073004, POPLA ruled that a witness statementwas 'not valid evidence'. This witness statement concerned evidencewhich could have been produced but was not. So if the operatorproduces a witness statement mentioning the contract, but does notproduce the actual un-redacted contract document, then POPLA shouldbe consistent and rule any such statement invalid.

                      Hello, Long time no speak. I have just had a decision & it was unsuccessful.
                      This was their reply:

                      The operator issued a Parking Charge Notice (PCN) to the appellant as no valid ticket, voucher, permit was on display.


                      Assessor summary of your case
                      The appellant states that she parked displaying a disabled blue badge but did not realise that a ticket was required.


                      Assessor supporting rational for decision
                      The operator issued a Parking Charge Notice (PCN) to the appellant for not clearly displaying a valid parking ticket, voucher or permit. The operator confirms that the site is a pay and display site and that there are 36 signs displayed around the site from the entrance to exit. The terms and conditions at the site state that payment must be made at the time of parking using the pay and display machine or via the mobile phone service. The operator confirms that the appellant was observed on the date of the event at 15.46 parked without displaying a valid pay and display ticket. The attendant confirms that the phone service RingGo was checked at 15.53 and no valid parking session was in progress at the time. From the photographic evidence provided it is clear to see that the appellant parked his vehicle directly in front of a sign. The operator states that the appellant was not parked displaying a valid ticket. It is the responsibility of the appellant to ensure that when they enter a car park that they have understood the terms and conditions of signage at the site. If the appellant was in disagreement with the terms and conditions of the site there would have been sufficient time to leave the site without entering into a contract with the operator, by remaining and parking at the site this is an acceptance of the terms and conditions. On this occasion the appellant has failed to follow the terms and conditions of the signage at the site and I conclude that the PCN was issued correctly. Accordingly this appeal should be refused.

                            Do you think that this could be because after POPLA rejection the fine is paid tho? £100 is bad enough i really cant afford court costs as well.

                              @mystery1 mystery !!!!!!! can you please have a look at my POPLA saga. I am at the stage where the MET has sent their evidence in response to my appeal. But I have a feeling there is still a way to a strong counter. I have 7 days to comment! well 6 now. PLEASE HELP, im your number 1 fan!
