I don't even know where to start on this form or defence to be honest and am really struggling and am still in recovery! Any help would be greatly appreciated.

    Hi CHARITYNJW, and thanks for responding.

    I don't have any of the original stuff but there was no windscreen notice etc. I did notice somebody had written to request the original letter from Civil Enforcement now. Should I do that? I have written up the details of the case where you suggestted. Is there any place I could send the pictures privately? there are many and the files will be too large.

      Just adding the link to my thread with the details and the PoC on it. I've also been back to the car park to look at the signs and so called Terms and Conditions apparently...

          Not yet. Do I just tick "1. I intend to defend all of this claim" and send off that one page with proof from the post office?

              Okay, done this. It's been acknowledged through the MOCL service. What should I do next?

                  CPR 31.14 request to CEL (or their sols if applicable.)

                  Ref: PCN (ref no, [xxx], court claim no [yyy],

                  Ask for
                  • A true copy of the relevant site signage
                  • True copies of the demands as mentioned in the Claimant's Particulars of Claim.
                  • Any other documents, pictures, etc that the Claimant intends to rely on to evidence their claim.
                  • A true copy of the agreement between the landowner (or any agent of same) and the Claimant, CEL
                  • A true copy of the P&D machine log for the relevant time/date.
                  & any other thing you think may be relevant.

                  All are free of charge.
                  Get proof of posting if via land mail.....very important!

                  If you intend to use email, let us know before you send anything off.

                  Did CEL/sols ever send you out a PAP before issuing the court claim?

                    This has literally just come up on my notifications! I did not know of or see this message until now!! What should I do now I'm really worried!? I did send out a sar a good while back and heard nothing at all since but not this! Is it worth still doing now?

                      It would seem that there is a live county court claim (form N1) in play, which you say you have acknowledged.
                      If so, what is the issue date? (Front of the claim form.)
