This sum is offered in full and final settlement of all matters between us. I usually send a cheque and say "if you do not agree do not bank the cheque but return it" though that may not be possible these days!

      Slight update.

spoke to a gentleman at excel asked him what could be done regarding the £70 he said I'd need to speak to the IAS first then contact them again. I asked if he could transfer me to the debt recovery team - he said they didn't have a number.

      rang the IAS, no answer!

rang excel back and spoke to a woman who said she would try to transfer me to the debt recovery team (you know the ones with no number) but that nothing could be done about the £70 fee so it was pointless. I've recorded both conversations.

the second call the woman stated that the fee is £70 I questioned her on the signage in the car park as that states differently. She was adamant it was £70.

      does this change anything?

p.s I also asked her to put a note on the account as the 28.2.23 is fast approaching and whilst I do the enquiry I don't want to incur additional charges. She said if I didn't pay the £170 it would go to court. I asked if it would definitely go to court and she said yes.

The first gentleman said they were an email only dept

the second lady tried to transfer me via the telephone. Their email is litigation@excelparking.co.uk

I'm guessing it's these who I email to contest?

Any help with wording of said email would be much appreciated!

Where did you get the £50 discounted price from? (Opening post #1).

It was the price to pay within 14 days but if you appeal to the IAS they removed this fee from you

                  Apologies £60

"However, if payment is received within 14 days of the Issue Date of this Notice, i.e. no
later than 07/11/2022 then a reduced amount of £60.00 will be accepted as full and

final settlement." Taken from the original notice to keeper.

does this make a difference to anything?

Any thoughts on the below as a draft?

                    Dear litigation team,

I am writing to contest the parking charge notice and debt collection fee that I received from your company. I have reviewed the terms and conditions of the car park where I received the charge notice, and I believe that the amount of the debt collection fee being requested is different from the amount stated on the sign in the car park.

Additionally, I would like to point out that I am waiting to hear back from the appeals service, a recommendation made by youth colleague today (21.2.23) so no fee should have been requested yet. I believe that it is premature to request a debt collection fee at this time.

I respectfully request that you provide me with an explanation for the discrepancy in the amount of the debt collection fee being requested, and that you refrain from taking any further action until the appeals process has been completed. I look forward to hearing from you soon.

A sum of £100 will be paid, if accepted this will be considered a full and final settlement of all matters between us.

                    Sincerely,

Thank you. The email has been submitted. What would the steps be if they do not reply? Especially before their deadline of 28.2.23?

                            Next steps?

                            1. Try another offer, or
                            2. Pay up in full, or
                            3. Wait to be taken to Court

                              Hi all

still no response from the company. Looking online does this section of the protection of freedoms act 2012 become relevant:

The notice must be given by—
(a)handing it to the keeper, or leaving it at a current address for service for the keeper, within the relevant period; or

(b)sending it by post to a current address for service for the keeper so that it is delivered to that address within the relevant period.

(5)The relevant period for the purposes of sub-paragraph (4) is the period of 14 days beginning with the day after that on which the specified period of parking ended.

given that the notice to keeper was sent on 24/10/22 and the alleged parking offence happened on 8/10/22?
