  • Help please- Letter of Claim from Lowell solicitors

    I just received a Letter of Claim from Lowell Solicitors on 03/06/2018, and have 30 days to send them the reply form, but just saw it today. Very worried if it is late.
    The Account start date 14/01/2013 Date of default 14/12/2013, the original company name is THree mobile, regarding 385.51 balance., so maybe a mobile contract.

    I also used to receive a Letter from Lowell Financial Ltd and attached with the Notice of Assignment from Three mobile said"assign the debt to debt partner Lowell Portfolio I Ltd".



    I will be really appreciate that you can give advice regarding the following please?

    1: Should I send them Reply Form,choosing C and asking for more information to Lowell Solicitors ?

    2: And also should I request 77-79 CCA Request to Lowell Portfolio I Ltd or Lowell Solicitors? If to Lowell Portfolio I ltd, could I make a copy of the request to Lowell Solicitors to let them know as well?

    3: Since it is a mobile contract not credit card, could I still need to use the templet for the 77-70 CCA Request ?

    4: But I do not have the address where I can send the 77-79 CCA Request to, I only have solicitor address, should I search google use address there ?

    5: someone said I should ask for CPR 31.14 Request, is it right to request this? coz it seems requested after the county court claim?

    It is nearly deadline now. I do appreciate if someone can give me the clearly advices please, I am quite new for all of these and may get confused, and have so many questions.

    agreement/ = Contract no doubt you had telecoms CPR31.14 Yes but at this stage you can only request items listed on the court form CPR 31.14 Request keep everything on here as personal e-mail not used so get rid of your e.mail from last item

      look around forums on the same subject and read and get an idea of procedures send CPR request to solicitors

        Hi Mike, thank you so much, I have deleted my personal email in my post.
        This is the Letter of Claim from Lowell Solicitor, not a claim from Court. I have 30 days to send Reply Form to them. at this stage, should I send CPR 31.14 request to solicitors? I just thinking this request only after I receiving the Court Claim but I am not in this case?

              Dont be scared, it's a process that's all xxx

              Compkete the reply form and ask them for documents to evidence their case - so statement of account to show how the amount claimed had been reached, termination it default notice, notice of assignment and the agreement and terms of the agreement.

              No no need to send a cca request unless you think the contract included the purchase of a device as well as airtime/data allowances.

              Did you have any dispute on the debt at all ?

              If you want to just sort out payment of the debt and hope to avoid having to deal with court in the future that's fine too - complete the income and expenditure form and offer an affordable monthly payment to them. It isn't guaranteed it will be accepted and they could still go to court if they think you should make higher payments so I would also ask for the documents and further information and write a letter saying you do not recognise the debt however as a goodwill gesture you are happy to make a payment arrangement while they sort out the evidence for you to check your records.

                What's the application btw ? You're a long way from a ccj affecting your credit file, but it is likely there is already a default on there - worth checking on noddle or clear-score if a default might also affect you.

                  once a claim issued then send a CPR31.14 request litening all items mentioned, meantime ask for contract from lowells for the telecom account send recorded delivery keep copy for yourself agreement should be mentioned in any court summons

                      I am confused WHO should i send CCA(if i should send CCA?) to?

                        No I did not have any dispute on the debt at all, i ignored it before and did nothing since i used to move flat alot.
                        I did checked.from Noddle, it is said Account start date 14/01/2013 Date of default 14/12/2013, on the breakdown years, the Default showing in March 2017,so further breakdown years.

                        I am trying to avoid this debt first.it is a large amount which is big pressure so should I NOT send CCA to some one?

                        My application will be settlement( indefinite leave to remain) since i have. lived for 10 years.i will apply it next month maybe.

                          If the debt defaulted in 2013 it will fall off the file next year

                            Dear Amethyst, thank you so much for your reply. Ok I will do that tomorrow. very frustrated now.

                            Should I attached a copy of CCA request to solicitors to let them know I sending this to Lowell portfolio?
                            Should I send both of these two using special delivery(recorded)?
                            Also I will use the templet from the link, should I change all "credit agreement" into "contract"?

                              After the Pre-action
                              claim letter, and my
                              sending the reply form back to the solicitors and CCA request to Lowell portfolio I Ltd,


                              I receive these letters from Lowell solicitor today( please see attached)


                              It says: "As this is former telecommunications matter it is not regulated by the Consumer Credit Act 1974, the original creditor is therefore not required to retain a copy of the Agreement, Subsequently, we are unable to request a copy of this document. A default Notice is a technical document that is applied to a Credit Agreement should a customer fail to repay the account.. As mobile phones have a Service Agreement and not a Credit Agreement, a Default Notice does not apply and is therefor not issued. "





                              Since then they only enclosed a simple bill which is only 92.17 pounds from 3G, but Lowell asking for 385.51 pounds now., there is no other document for how it comes to be 385.51. It is not on the Term and conditions they sent neither.





                              Also, on all the 3G letters, there is no 3G address at all.





                              They said they hold my case for 30 days, otherwise will take court procedure.





                              I am not sure about this phone contract, and not afford such big amount. What should I do next please?
