Will that cause me a huge problem?
    When is the hearing?

If it's listed for tomorrow then take three copies of your WS and Exhibits (letter/email to Lowells re handwriting expert?) and give one to the usher when you arrive at the court and ask them to pass it to the DJ before the hearing in case the one you emailed late in the day to the court hasn't been placed on the file.

Give one to Lowells representative (in case your emailed one to Lowells hasn't reached them) and keep one for yourself.

Unless your last DJ reserved this case for himself (which would surprise me) let's hope you get a more open-minded DJ who understands the CCA and won't tolerate Lowells' failure to provide honest and accurate documents.

    Good Luck

Yaaaay!!! Struck out, and the DJ was a demon; she relished it, her closing statement was elaborate and scathing.

                And £200 costs awarded.

THANKS and a massive hug to all the Beagles that helped me out. I am so, so grateful for the legal help and also the encouragement.

Im off to walk the dog and have a celebratory pint!

Re: Lowells Claim for Capital One Card

It was quite funny since I thought she'd already summed up, then I mentioned costs and so DJ explained the process and gave them until 30th December. I got up to go and almost as an afterthought she said "oh, wait a second, since this is being recorded I have something to add..."

It was a bit of a blur but went along the lines of "unnecessarily long and drawn out process, claimant repeatedly failed to comply with orders, defendant repeatedly put claimant to task to provide evidence which was un forthcoming, exemplary conduct from defendant, failure to attend..."

                    She slathered it on.

                      Nice one, ADDLED.

It would be good if you could give us a precis of the hearing.

Hope you enjoy that well-deserved pint!

You can ask certainly Add, judges all have varying views on costs and small claims.

Have you been told they are not attending or have they been in touch with the court?
