There's often confusion Add when credit files are updated by a debt purchaser an entry is marked " updated " and the date is shown. It can be confused as being a new default date.

Do you know when Lowell were assigned the debt?

Hi everyone, hope you all had a good christmas.
I spoke to Lowells this morning to see if theyve responded to the costs order and they say their system isnt updated yet. Considering their continual contempt I don't hold out much hope of being paid by tomorrow's deadline.

Do they pay me or the court?
If they don't pay, what can I do?

        tks.

                What for?

The deadline is tomorrow so they've not breached any court order yet.

You have a costs order against Lowell and this can be enforced in the same way as a Judgment. Therefore if you don't receive the costs today/tomorrow you should contact them and ask when it will be paid as you will be applying for a warrant of control and the cost of that (I believe £77 now) will be added to the amount they owe. How much were the costs you were awarded and do you have the judgment order from the court ?

                  For ref:

EX322 How do I ask for a warrant of control?

Tks all. Appreciate Im a bit hasty but wanted to know my options if, hypothetically, they didn't pay.

Of course you do., but putting things into perspective is no bad thing.

By the time you put into practice heavyhanded court options available to you, they may well have paid.

Most law firms are closed for the Christmas and New Year holiday, and the post is still a bit behind. As much as you understandably want revenge you also need to be reasonable in the eyes of the court.

Only after they've breached any court order.

                              Hi everyone, happy new year!

Update: Guess what... Lowells haven't paid. I called them today and they said (again) that they hadn't had the court order. I had it about 2 weeks ago via good old reliable Royal Mail.
I appreciate the advice that it's best for me to have been reasonable, and i think I have, but this is now the 4th court order they've ignored and this one is financially in my favour so I'm a bit keen.
It seems Lowells aren't your usual law firm as they were open over the Christmas period (I've called them a few times and spoken to desk jockeys). Most reputable firms may well close down and give their staff paid hols, these clowns seem to keep a cohort of slaves manning the phones 7/365, so it's not as if their office hasn't been manned.

Ive decided to leave it until Friday, call them again and then issue a warrant of control. Given the timeframe, is that reasonable?

                              cheers
