    Don't get ahead of yourself, it is likely to be a good couple months before any hearing date, the N180's have to go in, the case allocated to a track and a court and papers sent over to your local court who then sit on them for a bit then send a court date usually with at least a months notice xxx You are correct though, as things stand you would argue the enforceability of the agreement - the judge has no choice but to rule against the claimant while they are in default of the CCA. If things do turn up then you can get into whys and wherefores and considering negotations etc.

      This is the N180 - if you wanted to fill it in and leave it for your sis to post at the relevant moment.

      Copy of that goes to the claimant ( as well as the original to court) as well as the Defence ( original to court and copy to claimant if you are doing it on paper - if you were doing it on MCOL then the court do that for you )

      however I have just realised I've made a mistake. Message to all PLEASE HELP

      I did read the above, but it didn't sink in .. I'm panicking because I didn't send a copy of my N9B & defence to the Claimant! PLEASE HELP, MY DEADLINE IS SUNDAY 8TH DECEMBER and now I couldn't send anything till Saturday morning in about 9 hours. I don't see how it could make it on time. HAVE I MESSED UP CRITICALLY HERE. Please, don't spare my feelings...how bad is this and what should I do?

        ALSO: Message to all PLEASE HELP :doggieyes: TIME SENSITIVE !!

        It feels like my goose is cooked, but I keep having mad thoughts how I could retrieve this?


        Can I email or Courier the copy of my defence to the Claimant?
        Is there anything I can do to avert disaster? My deadline is Sunday 6th, and its 02:20 on Saturday morning now. So I have just a few hours in the morning to get a copy there one way or another by Sunday.

        When I send a copy of my Defence to the Claimant does it mean I send it to Cabot or Shoosmiths (their Solicitors) ?

            Courier would work I believe ... did you use MCOL to submit your forms or send paper ones?
            Debt is like any other trap, easy enough to get into, but hard enough to get out of.

            It doesn't matter where your journey begins, so long as you begin it...

                    yep ... the claimant gets a copy (you could always send one via ordinary post to shoesmiths too - play it safe?)

                        Hi Kati,
                        this is definitely an 11th hour production! ainkiller:

                        I have a courier driving to both Shoosmiths and Cabot with copies of my defence, he is setting off now to pick up the documents.

                        The MASTERCOPY of my defence has gone to the Court in plenty of time to beat the deadline using proof of postage.


                        The courier is charging me £330 .. but I'd rather pay that then £6,200 !
                        He says he can provide proof that the documents arrive today (before their Sunday 6th Deadline). Even if they are not there he will give me Video evidence and a stamp. So I can prove to the court the claimant received service of paperwork before the DEADLINE - Sunday 6th.


                        Snatching VICTORY from the Jaws Of Defeat since '64' hehe fingers crossed. Had no sleep last night due to this. I realised at 11.30 last night. Too late to really do anything except worry .. (which I'm so good at I have a doctorate in).

                          Hi.
                          the courier has picked up my documents and driven from York to Northampton, dropped off 'my defence' documents at Shoosmiths and a security guard has singed for them. Its about 3.30pm , now he's on his way to Cabot (near Maidstone). Its a lot of mileage.
                          I'm now thinking I should have used the 'Same Day Royal Mail delivery service'. I tried to click on the link to check them earlier and it wouldn't click (I was near that stage when I start shouting at inanimate objects.! :smash:

                          So I ended up using the courier I'm using now. He's doing a wonderful job, its just very expensive. I had to put myself in debt to pay his £330 wages for today ... :ballchain:


                          Still, at least I realised I'd made a mistake when I did and I have an 11th hour solution in progress (even if its costing £330) . I'm still in the running with my DEFENCE, with a possibility to save £6200 !
                          I VERY NEARLY MISSED MY ERROR COMPLETELY AND THAT WOULD HAVE BEEN IT, SO REALLY I'VE BEEN VERY LUCKY. I NEED TO BE PHILOSPHICAL ABOUT THE COST OF THE COURIER IN VIEW OF THE GREATER GOOD...

                              Oh gosh, bloody hell, sorry I've not been around this weekend ( birthday ) - don't worry about the copy to the claimant, with the defence if its a couple days behind it's not fatal at all the important bit is the court, so as long as you sent it in to the court on time it'd be absolutely fine. For future ref though if a deadline is on a Sunday it is best to try get things in for the Friday before.

                              Also ( sorry ) it would go to the address for documents on the claim form, which will be shoosmiths, as they are acting for the claimant - the claimant in this instance won't have a sodding clue what to do with a defence as their solicitors deal with it all for them ( hence using their address for documents)

                                congratulations on your birthday (or someone elses!)

                                I've gone off to visit my family now. I'm away for all of the Christmas new year period. I've left a pre-completed N180 with my sister to send to Shoosmiths and the Court. Thanks again for all your help. No worries re: the Defence. I got the info to them in the end. Shortly after i got a letter from CABOT saying that unfortunately they had not been able to come up with the requested documents in the allotted time period, but that i should make haste to contact their customer service dept and arrange a payment plan (i think I'll wait till court). Please can anyone give me any advace info on what my witness statement should contain?
                                IMPORTANT: i suffer from electromagnetic hypersensitivity and (as well as my spinal condition) have a badly broken heel bone from falling down the stairs a while back . i did mention it in a post. This means i cant get out easily and i cant use wifi internet cafes. i have to find a pc with a hard wire connection. Therefore i wont be able to log into the forum very often during the next month. But just so you know I will be continuing with my updates / logging the progress of my defence so please dont close down this thread !!
