Don't get ahead of yourself, it is likely to be a good couple months before any hearing date, the N180's have to go in, the case allocated to a track and a court and papers sent over to your local court who then sit on them for a bit then send a court date usually with at least a months notice xxx You are correct though, as things stand you would argue the enforceability of the agreement - the judge has no choice but to rule against the claimant while they are in default of the CCA. If things do turn up then you can get into whys and wherefores and considering negotations etc.

) - don't worry about the copy to the claimant, with the defence if its a couple days behind it's not fatal at all the important bit is the court, so as long as you sent it in to the court on time it'd be absolutely fine. For future ref though if a deadline is on a Sunday it is best to try get things in for the Friday before.
