    I'm just getting anxious now as date for hearing is 18/2. I've called the courts and it's going ahead etc...by sounds of it they only have my witness statements nothing from lowell /bw but they paid the £80 fee. They didn't send me Any of the requests CCA... When I first started this I tried to get in touch via letter to bw and said I need to know what the debt is for etc....if I owe that amount that's fine but I need proof this was an informal letter which unfortunately I don't have a copy and also didn't realise bw would hit me with a court order either. Even though I sent this informal letter and there after followed all beagles advice about requests etc should bw legl still supply me with proof?

      Okay your defence is completely fine. They have not sent you any evidence of the debt, nor have they complied with the requirements of the consumer credit act. Yes they should have submitted a Witness Statement before now, with copies of the documents. As they have not sent in witness statements or documents they shouldn't be able to bring them to court on the dat. You could apply to strike out the claim - it would cost you £50 - an application without a hearing due to the claimant failing to comply with the courts order to file and serve witness statements.

      Would be good if you can post a copy of the hearing order from the court that states about Witness Statements pls. xxx

        just got home today and their is a letter from bw saying claimant are discontinuing with all the claim "notice of discontinuance"

        so i take it this is the end of it ?

              Yes I will email it over when I get home. I can't thank you enough for your time, efforts and sound advice and being there.
              When you take a minute to think about all the many posts on the forum where people like myself need advice and assurance.
              I'm still in shock and stumped for words on the outcome.
