    thanks for your reply... can I ask the standard letters of request I sent to the claimant are they not suppose to send me the copy of agreement and if they haven't how can I argue the case without it.

      Also I sent defence to claimant and not their solicitors claimant wrote to me saying their solicitors were dealing with it and with it was a new amount from the actual amount they are saying I owe up by £80 can they do this

          Hiya, Well if they don't get them before witness statements are due ( usually 14 days before ) they might discontinue. Check your hearing date letter to see if there is a specific date you need to put in your Witness Statement by.

            The court date is in 15 days. That's when I'm suppose to attend. Delivery receipt states court received my defence in time. Just I don't have much to go on as I'm not sure of the debt or amount.

              Okay - does the hearing letter state anything about documents to be sent to court? It's usually on the second page.

                  I had to send defence to opponent and court which I did by end Dec, court received it on the date in the morning. then claimant has to pay fee by beginning of January, then a date set for hearing on 18/2 this is on page two

                      They have paid the fee I've been told to turn up and tell the judge on the day. Really nervous about it all.

                        It can be a bit hit or miss who you get on the phone with the courts. I am a little bit confused, when you say defence do you mean witness statement/documents you intend to rely on in court... shall we just go through what's happened to date

                        1) received claim
                        2) sent acknowledgment of service
                        3) sent defence
                        4) sent allocation/directions questionnaire
                        5) got letter ref hearing date/mediation
                        6) sent in witness statement ?

                          Sorry, meant to say witness statement I have done all the above. The hearing date is in 15 days I've called courts and claimant have paid fees I on the other hand have received nothing from claimant

                            Good stuff xx Have they sent you no witness statement or anything ? After tomorrow I'd give the court a call and check whether they have had anything from claimant at all.

                              I sent off my witness statement, defence (again) all correspondence to both court and claimant. Which is all I rely on in court. I have heard nothing since sending off on 23/12. I called court just before and they said the claimant have paid £80 and I should turn up for the court date. ( Not had anything from the cca or cpr requests)

                                Am I suppose to receive witness statement not sure what happens. All the court person said was they have paid and to turn up for the hearing etc....

                                Acknowledge Claim - within 14 days from Service

                                Defend Claim - within 28 days from Service (IF you acknowledged in time)

                                If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
