Hi All,

Forgive me if i should be asking this elsewhwere, this is my first thread and im in a little panic. I had a letter from BC a few weeks ago asking for me to arrange a payment of an old debt to Very (which got sold to lowell) then passed to him. Through various reasons i stopped paying Lowell sometime ago and having moved a few times things have obviously lapsed and only just come to my attention again. I admit to oweing the money and tried to make an arrangemnet via BC website which my last 3 or 4 emails have just been ignored. Then i have a letter saying a claim form from Northampton would be with me withihng 48hrs which is was the next morning. I am filling the forms out but confused as i agree to owing the money but dont see why i should pay extra interest and fees when id already made an offer via the website prior to getting this claim form. What should i do, i feel sick at the thought of a CCJ.

Hi whatnest

If you are referring to disclosure, you do what the court instructs, & do it on, or before, the date which the court has indicated.
In Small Claims there is what is known as 'Standard Directions' which can be found in CPR PD 27 Annexe B.

But sometimes different directions may be given.

I'd wait till 16 days before the hearing, just in case they come up with the credit agreement. If you send it now (as you need to send a copy to them as well) it might encourage them to make more effort finding it, so I'd wait.

Does the 14 day rule still apply ? and is that working days ?

Hearing date is 25th November I haven't posted as nothing to report
I checked yesterday and the hearing fee has been paid
I now have about 2weeks to prepare my WS
Will post up later for guidance

Good luck. Hopefully you will get the same outcome. I thought when fee was paid that was it I was doomed but Hey ho all smiles in my neck of the woods at min.. Fingers crossed for you IOM xx

For now ... yes. As things stand marks on the credit file are not considered as enforcement under the CCA. So even if a debt is unenforceable the credit markers remain.

I'm assuming it has to stay on my credit file? The default date shows 12.7.2010 so until 2016? Thanks

So glad you've had this weight lifted off your shoulders, I hope you will stick about and help others who have similar claims (we're a little overworked lol) It's been a long trek for you but you stuck with it and you know exactly what other's are going through.

Happy days or what. Can't quite believe it. Slept soundly lay night. No bad thoughts ruining my zzzzz's. I do hope others hang on in there if their case is similar to mine. Without this site people would fold instantly or there would be a mass more ccjs in the country.

Massive well done!
I know what BC Lowells are like - parasites! (Much stronger words used off forum!!) I had a teeny weeny drink when mine was discontinued Like you, couldn't have done it without LB!!
