            Yes, they can ask a judge to " test " a recon agreement but I think from 2003 they'll struggle either way!

                  Been contacted today by MC solicitors on behalf of Cabot stating court proceedings will be issued last chance to make a payment contained a expenditure sheet not heard back yet front Cabot regard my CCA request what should I do now

                    Ref: use theirs.
                    I refer to your letter threatening court action and refer you to my request for information ( CCA Request ) dated xxxxx and CPR 31.14 request dated......'

                        Just posted my letter thanks nem and wanted to add on the back of the letter from MC at the bottom there is a reduced balance offer if I get in touch missed that yesterday when I originally read it so fingers crossed thing they are pushing there luck

                          MC are always pushing discounts when they have no documentation to support the claim.
                          Always keep in mind that the claimant has to prove on the balance of probabilities that you owe the debt.
