    I will follow your advice and not bother with the SAR and do everything else tomorrow. Hopefully I do not get a CCJ and I will keep you updated with letters. Not to sound to repetitive but thank you so much.

        Hello Again
        It has been nearly two since I first posted and I have not heard anything back from Drydens. I spoke to the Court today and was told I need to give my defence of the case in before or by middle of next week. Not sure how to proceed,forthwith. Any further advice would be most appreciated.

              What date was your claim issued ? (printed top of claim form) then we can work out exact date for having defence in.

              If you've had nothing back from Drydens or Cabot then we'll be needing to put in a defence.

              Alternatively you can ask Drydens if their client would agree to an extension of the date for filing your defence as they have failed to provide you with any documents evidencing their claim and there is no copy agreement yet.

              That would give you a further 28 days and them more time to come up with the documents before you defend. I think Drydens usually say no but its a good idea to ask as then you can say in the defence you tried to give them more time but they declined. If you do get them to agree to more time and they still don't get the documents then it looks worse for them in court too. And if they do come up with the documents you have a better idea if your defence is going to succeed.

              Have a look at the defence and see what you think. Think of any additional issues you might have had with the debt to, and we'll help you put it all together.

                Afternoon Sharon
                Thank you for your reply, sorry I couldn't respond yesterday-was at work. My claim form is dated 19th December, should I ring Dryden? My concern is that they may just claim that I did not ring them. Not sure, other than CCA not provided defence-what if any other defence I may have? I ran into financial difficulties due to lack of work. Though I did not claim any benefits because I quit my job. I lived with family who supported me. Not sure if that is relevant. I am still waiting for the post today but I think I should just fill out the form online, with just the no CCA point, and use the last point of reserving the right to change my defence should the documents be produced. I can ring them later today If you think that would be a good idea.
                Hopefully I have made sense any extra things that need adding-I will do If you think that would be useful.

                          If they agree .... you need to get them to email you proof of the extension to send on to the court

                              I have just spoken to them, they told me that my account is on hold whilst their clients deals with my CCA request. They told me I literally do not need to do anything else. That I do not need to fill out my defence because they are not going to do anything until their client responds. I was rather weary of this response and asked for an email to confirm conversation. i was told a test email would first be sent out and then the follow email confirming my account is on hold and no action is required.
                              I will update and further advice on how to proceed would be greatly received by me.

                                It might be an idea to sort out your defence anyway ... they might just try and get a default judgement
                                If you do get an email saying you don't need to do anything I'd (personally) forward it to the courts - it might be good to use in a defence if they go for the default judgement :tinysmile_twink_t2:
