CCJ Claim Form from Cabot/Mortimer

I’ve received a written acknowledgment from court this morning. Copy attached. So they are issuing the defence to Mortimers as I read it then it’s 28 days to wait. Eeeek.

Exactly Next you will receive either a Directions Questionnaire from the court, or nothing.... if nothing after 5 weeks from now then give court a call and check on the status of the claim. If stayed you can consider what you want to do with it - there is a possibility of applying to strike it out yourself, rather than just waiting for an indeterminate amount of time to see if they find documents. Otherwise it's a case of completing the DQ and returning to the court, copying to claimant, and again, waiting to see if they come up with documents before Mediation.

Lovely little letter from Mortimers this morning. Honestly the personal stress this has caused me over Christmas is huge and I’m glad I’m finally seeing a little light. Counting the days until the 1st March when hopefully this nightmare will be over

Bit narky isn't it. Don't take it to heart - sadly, you're still just a number. Cabot are getting better but it's taking time to get through to MC that there are real people on the receiving end of their letters.

Well, see what happens by end of Feb and then you can consider either making a reduced / installment settlement offer or applying to strike - as you already gave them an extension I think a strike would probably work rather than just get an order to provide the documents, but it depends how stressful you want it to be lol. Let's see where we are by March tho, just shout if you receive anything xxxxx

Well I’ve waited and never heard a dicky bird from either Cabot, Mortimers or the court so far

Okay, well, it really depends what you want to do.... leave it and deal with whatever happens at some undefined point in the future, or try get it settled / struck out now. Every way has risks of course and there's no 'right' answer so really depends how you feel about it.

First thing though is just to give the court a call ( Northampton CCBC ) and ask them what the current status of the case is as you haven't heard anything for a while. SHOULD be stayed.
