Scots courts do a roll list and the case is listed on there ( although says sheriff unallocated ) so must be mystical powers ... ( unless @ScottishSolicitor was there on another case - note a case brought by PRA was heard today too )#staysafestayhome

i don’t understand why they sent me all those docs and then didn’t have them in court, the sheriff said they had only produced 1 of what was ordered and fact is they have sent me more, the 1 they produced I only got today ?

4 months ? Well, that seems overly generous - maybe a typo / admin cock up ( could call court and get them to double check the order that came from the Judge ) or maybe you misheard the Judge ( though that seems unlikely ).#staysafestayhome

This is from the original order...
The sheriff has responded....
The Sheriff orders the claimant to lodge the following documents at or before the CMD, failing which the action may be dismissed:
1. The original loan agreement.
2. The assignation of the debt.
3. Proof of intimation of the assignation upon the respondent .
4. Default notice.
5. Proof of intimation of the default notice.
6. Statement of account.
funny thing is, they sent me the loan agreement, the assignation, proof of assignation, but thy didn’t seem to have these at the cmd, they then gave me a statement at the cmd from the original creditor... haven’t got the default notice or proof of default notice as of yet.
sont understand why they didn’t seem to have anything at the cmd except the statement which I hadn’t even been sent ??

Acknowledge Claim - within 14 days from Service
Defend Claim - within 28 days from Service (IF you acknowledged in time)
If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
