    Could anyone help me with this please, worried as want it ready to send first thing Tuesday as I have a funeral to go to that day so want the worry of having it ready before

      Re the CPR 31.14 request, you can ask for:
      The Default Notice
      The Notice of Assignment
      A copy of the regulated agreement at inception plus all documents referred to within it, any variations, & a signed statement of the account.

      Btw, re date for defence.......don't worry about writing the actual date; just leave it at 'before filing my defence' or words to that effect.

          That's it for the moment, unless you get any replies / documents from the claimants then you will be wanted to file your defence around 18th Sept. ( little leaway as you have 33 days from 22nd August to put the defence ( or admission ) in to the court.

          Just let us know soon as you receive any responses

              So far I've had 2 letters back from Lowell solicitors, 1 is a notice of claim issue and the other says

              thank you for your correspondence received 31 August
              we note the contents and write to advise you that we have requested a copy of the documents relating to your account from our client and will forward these upon receipt , please note this if for your information only.

              we confirm we have recieved notification that your acknowledgement of service has been filed, providing you with an extension of 14 days to respond to the outstanding county court claim. Failure to respond to the outstanding claim may result in an application being made to the court to enter judgement against you in default.

              is this normal and I still don't need to do anything until around 18th September ?

                        So no copies of documents from the claimants? You have a couple days so start putting defence together - it will be pretty much standard - S.78 Consumer Credit Act ( as a catalogue account is running credit ) Do you want to have an adapt of the example defence and we can give it a once over so you can submit it tmw.

                          No I've received no documents from the claimants. I've typed my defence, I'm not sure on a few parts and have left out part 12, I would be very grateful if you could please look through this.

                                Acknowledge Claim - within 14 days from Service

                                Defend Claim - within 28 days from Service (IF you acknowledged in time)

                                If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
