  • Money claim by Lowell portfolio LTD

    Received a money claim from the HM courts. The money claim is for a phone contract taking out about 5-6 years ago.
    I currently do not live in the U.K. And have not received any other letters or emails apart form this this form that was sent to my old address. I have acknowledged the claim. The amount owed is £968 pounds which is impossible this seems to be with all fees added were do I go from here I can not pay this in full but do not want to pay that amount as in sure this was not the original amount. I do not have a job or any income. Thanks

    Good morning Shelley, welcome to LB,

    Please (if possible) post a copy of the claim form after removing all personal data and the claim number, if you can't do this please type in the Particulars of Claim word for word.

    Any other details on the debt will help us advise more fully.

            ok great i have sent the form to kat yesterday and she lead me to thıs forum but ı can send ıt to agaın now yes was born ın the uk but moved abroad 5 years ago

                        Do you have any idea when you stopped payments on the contract with O2? Was it before July 2010?

                        Also do you recall when the contract was due to end? ( or when you took it out and how long you were tied in for ?)

                          ım sure ıt was before 2010 but ıt was so long ago ı can not remember. ı have been livıng abroad for 5 years now so was before that ı am sure but do not know how else to fınd out wıthout contackıng them i think it may have been a 1 year contrack

                            Ok telecoms account with O2, passed to Lowell 23/12/2011 claim 30/06/16.


                            Do you know when the last payment was made on this account or when you received their " Final Invoice"?
                            When was the account opened?
                            Have you checked to see if this account is still on your credit files? If not try Noddle free online, check account details inc. the default date registered on the file.



                            Acknowledged the service of the claim/. Intention to defend/

                            Next send Lowell Solicitors a request for the documents mentioned in the particulars of claim i.e. the Agreement, the Default Notice and the Notice of assignment.

                            This is a request made under the provisions of Civil Procedure Rule 31 .14 ( No fee payable).
                            There's a template in the green box at the top of the page. The request has a compliance time scale of 7 days.
                            Lowell solicitors may come back with some of reply but most times they ignore requests.

                              Okay. You could contact O2 about it and ask them when your contract ended. Otherwise you can state it is statute barred when doing the defence and leave it to the claimant to dispute it.

                              With regards the county court claim you need to acknowledge the claim now ( see First Steps ) and you should send the CPR 31.14 letter (CPR 31.14 Request ) asking for more information - the contract, the default notice and the notice of assignment - that should go to the solicitors firm ( so Lowell Solicitors in Northampton )

                              The CCA request isn't applicable.

                              You have 33 days from the date of issue printed on the claim form to submit your defence, but the acknowledgement of service needs to be done within 14 days.
