    Can you clarify if what you have received from B W Legal today is their Witness Statement and Exhibits (it appears to be).

    If so, then they may have filed their WS early (it's allowed) if the hearing is listed for 5th December.

    Did the Notice of Hearing/Directions say both parties should file their WS and any evidence they intend to rely on fourteen days before the hearing, or was it date specific?

      OK iv emailed the over yes it's their witness statements and evidence . The court letter just said 14 days before so yes theirs is early and I plan on getting mine in asap upon your advice lol

        So they've shown their hand early which is helpful

        Now you know all the evidence they've got you can run forensics over it before you file/serve your WS.

          Well iv sent them over ... this is the reason I left mine as wanted to see what they sent...I'm hoping we can sort this it's giving me sleepless nights and making me feel sick. The thought of going to court also is awful

            No one likes going to court except lawyers.

            This is why your WS is so important.

            If you find yourself tongue-tied in court you can simply direct the DJ to a paragraph in your statement.
