      I see probably just a error then, youd think they would make sure they got the particulars bang on wouldnt you. So im sending the cca to lowells with a £1 postal order and a cpr to cohen cramer?

      i will defend now online.

      if i lose the case will i get a chance to show my income and expenditure, they have put in a previous letter there going to ask for £50 a month to which i have no chance of paying

        1 other thing i notice the issue date on this was the 15th feb? i didnt get it until they 18th i have just defended today rhe 20th i havent missed the deadline have i??

            You've acknowledged the claim by ticking the 'intend to defend in full' box?

            If the issue date is 15th Feb then your defence will be due in around 15th March.

                Hi i have receieved a letter from cohen cramer today stating they have notified lowells of my request, they have given them 45 days from the date of the request to send the documents. It goes on to say that they have notified the court of this agreed extension of time which will provide me with enough time to prepare my defence should i require this. As such they will allow an extension of time to end 14 days after they have supplied the documents, in the meantime they will take no futher action and hold my account until i have had reasonable amount of time to inspect the documents and consider my position.

                Seems fairly reasonable but do i still file my defense on the date originally set?

                  I'm sure the maximum extension allowed is 28days and that the DEFENDANT has to inform the courts :noidea: ( [MENTION=55034]nemesis45[/MENTION] @Amethyst ... can you confirm??). If so ... their letter is IMO an attempt to get a default judgement

                    Yes the maximum extension under CPR 15.5 is 28 days. And yes it is for the Defendant to notify the court.

                    You can either just get your defence in to court by the deadline ( original deadline that is) or write to them and tell them they are wrong and you will be filing your defence on XXX original deadline date XXX unless they confirm in writing the agree to an extension pursuant to CPR 15.5 so that you may inform the court.

                    Agreement extending the period for filing a defence

                    15.5

                    (1) The defendant and the claimant may agree that the period for filing a defence specified in rule 15.4 shall be extended by up to 28 days.

                    (2) Where the defendant and the claimant agree to extend the period for filing a defence, the defendant must notify the court in writing.

                      Is that a sly move then? how would that look in court if it did default and i had this letter (would i be to blame for naivety?) would you suggest allowing this extension? not sure upon what id base my defense on if im not giving them adequate time to provide the documents? would it be worth ringing the court?

                        as [MENTION=6]Amethyst[/MENTION] says ... contact them and ask for written confirmation of an extension (as per CPR 15.5). If they do not give you that (max 28 days) then your defence NEEDS to be entered within 33 days of issue of the court form)

                          Is that letter not classed as written confirmation? shall i ring up cohen cramer or send them a letter? also the same to the courts if they agree to the extension?

                            they have 28 days that is it, you can see the dirty tricks they are playing you do nothing they get CCJ etc by default, follow what Ame etc says

                                How you getting on? Defence will need filing pretty soon if you didn't agree an extension and inform the court.
