Lowell solicitors threatening to send debt to bulk centre by 30th dec.Also states that I can still pay or make arrangements to pay.This debt is for a shop direct debt that was sold to Lowells about 4 years ago,Since then,I have requested proof and agreement proof twice,but all I got was an offer to reduce balance by 50%? That was a year ago,And now,i am a bit concerned they are after a claim and possibly ccj.Any help and advice appreciated,Please bear with me,as my computer is old,and I am new to the forum!

can you tell us when you last paid anything towards or acknowledged the debt in writing??Debt is like any other trap, easy enough to get into, but hard enough to get out of.

When was the last payment and or written acknowledgment made in regard
to this debt/
Have you checked your credit reference files lately? If not check Noddle it
may give us some indication of the status of the account in relation to the
Limitation Act 1980.

Hi nem,I made a last payment of ten pounds in june 2011.None since. As I was on the breadline.Payment was made to littlewoods shopping,Then they passed me on to Lowells later. I have never heard of noddle,is it a credit ref Just had a look at noddle,after looking at web,But why would they need your credit card?

Have you sent Lowell a CCA request for a copy of the agreement?
If not do one and send it tomorrow there's a template in the forum
library.
You need to send the £1 statutory fee with the request, use a Postal Order endorsed " For Statutory Fee Only"
Lowell has 12 + 2 working days to comply.
Use signed for post and check the delivery date.

Hi,I have now received claim forms from Northampton bulk claim centre .Claim is being made by Lowell Portfolio,And I asked advice from you before xmas.I explained that I had written for proof of agreement ages ago from Lowells,Which they ignored,And sent me an offer of 50% discount from the balance.You informed me that with no agreement they cant enforce payments.The thing is,Now I have the claim forms,And still no copy of agreement or other papers,Do I just put in a defence saying I don't owe the money?I only received the claim this morning,and I know I have to register it online,Which I intend to do later today Thankyou for any help,Vale.

Without the agreement they can't enforce the debt no, enforcement is deemed as 'judgment' not as bringing the court action ( irritatingly ).
