That was a year ago,And now,i am a bit concerned they are after a claim and possibly ccj.Any help and advice appreciated,Please bear with me,as my computer is old,and I am new to the forum!

Well the debts not statute barred.
Have you sent Lowell a CCA request for a copy of the agreement?
If not do one and send it tomorrow there's a template in the forum
            library.

You need to send the £1 statutory fee with the request, use a Postal Order endorsed " For Statutory Fee Only"
Lowell has 12 + 2 working days to comply.
Use signed for post and check the delivery date.

Ok a formal CCA request Not Complied with renders the debt unenforceable until an agreement or a compliant agreement has been produced.
If this is the case Do Not Chase the CCA request,

The period up to Christmas really is the silly season in murky depths of the debt collection pond.
The bottom feeders seem intent on making peoples lives a misery, just vexatious in my opinion.
If they haven't got the agreement they can't enforce payment.

Claim from lowells portfolio northampton bulk centre.

Hi,I have now received claim forms from Northampton bulk claim centre .Claim is being made by Lowell Portfolio,And I asked advice from you before xmas.I explained that I had written for proof of agreement ages ago from Lowells,Which they ignored,And sent me an offer of 50% discount from the balance. You informed me that with no agreement they cant enforce payments. The thing is,Now I have the claim forms,And still no copy of agreement or other papers,Do I just put in a defence saying I don't owe the money?I only received the claim this morning, and I know I have to register it online,Which I intend to do later today Thankyou for any help,Vale.

Without the agreement they can't enforce the debt no, enforcement is deemed as 'judgment' not as bringing the court action ( irritatingly ).

If you have already sent a CCA request to Lowell - http://www.legalbeagles.info/forums/...t-Court-Claims is an example of a starting point for a defence.
