    I really need some advice, i have received a letter from Mortimer Clarke today that i would like some help with.

    If anyone is able to help me please respond so i can give details.

      Basically, i had a HP agreement with Blackhorse and the car got repossessed as payments weren't kept up. Since then the debt has been passed around a few companies, non of which i have ever responded to (or even kept any letters);
      It was 2008 the car was repossessed and since the day it was taken away i have made no contact with anyone about it.

      So today, i received a letter from Mortimer Clarke saying that they have not received any response to the claim form served on me. Accordingly they have now requested that the court grants judgement in default in favour of their client.

      Dont know what to do or where to start,

        Did you receive a " claim pack " from the Northampton County Court Business Centre.
        The claim would gave been I guess issued on behalf of Cabot or Hillesden Securities??



        You say this has been around the debt collection companies, when did you last make any payment
        on this account?

        Have you checked your credit files recently? If not try Noddle it's free online.
        My guess is that this is statute barred anyway.
        Is there an e-mail address on MC's letter?

          I haven't received a claim pack, but by the sound of the letter I should have?

          It is hillesden securities they are claiming for.

          The last payment made was directly to Blackhorse, prior to the repossession. It is not on my credit file, I signed up to Experian s while ago out of curiosity.

            ......


            Date:

            Ref: use what's on their letter.

            Sir / Madam,

            I refer to your letter dated ........................: received on .......................: in regard to an alleged debt
            arising from an account with Black Horse Finance please take not I do not acknowledge any
            liability for the alleged debt.

            Your letter is the first contact I have received regarding the alleged debt for over 6 years
            and I have most certainly not received any court papers from Mortimer Clarke of its client.

            My position is that the alleged debt is statute barred under the provisions of the Limitation
            Act 1980.

            Should this matter proceed to a summary judgement I will immediately make application
            for the judgement to be set aside and I will seek the cost of the application from your client.

            Your immediate reply would be appreciated.

            If there's an e-mail address on MC's letter use that and follow up with a signed for post
            letter.

                If yo want to try and sort out the other debts start a new thread and we can deal with
                them on priority basis.

                    How they respond I guess will based on what they have or have not got to
                    prove their claim.


                    Possibly they may make a " gracious" offer of a discount on the debt if you pay up
                    before the claim goes any further, but the response is unpredictable.

                      Yesterday I came home to a letter from court, stating that it is ordered that i pay the debt , £50 per month ,

                      Now what do i do? This has happened so quick!

                        Mortimer Clarke Solicitors - Judgement

                        Any help would be so much appreciated, on Wednesday (13th Jan) I got a letter from Mortimer Clarke about an old debt (2008) stating that i hadnt responded to claim form served on me - something that i know nothing about.

                        Today (15th Jan) I have received a letter from County Court Business Centre Northampton ordering that i have to pay £50 per month until the debt is paid off.

                        I dont know what to do about this or where to start. On Wednesday i posted on here and was told the debt is probably statue barred, is there anything i can do to sort this out?

                          Welcome to the forum xxx

                          It sounds like they have obtained a default judgment against you, mainly it seems because you didn't receive the court forms.

                          I'll check out your previous thread - you may need to apply to set aside the judgment on the grounds you didn't know anything about the claim and have a full defence.
