    Hi, I've not received anything since they sent the signed agreement. I'm using my phone and have tried to screen shot and add it to the messages but it's not working.

                    Hi, so sorry for the late reply. It does not state either. The letter says please find enclosed all of the relevant information following your request for information under section (77-78) of consumer credit act.

                    We consider the agreement is now enforceable and therefore we are entitled to obtain a ccj against you. However, we would prefer that you work with us to set up a repayment plan to settle your outstanding balance.

                    Today I received a letter from shoosmiths.......

                    We write with reference to the above matter and further to our letter dated 22 December ( I never received this letter)

                    We are disappointed to note that we have yet to receive a response from you in respect of this matter.

                    As previously mentioned our client would like to bring the matter to a resolution at the earliest opportunity. Our client has previously conveyed a willingness to accept £xxx in full and final settlement.

                    I have not heard anything from the court??!

                    What should I do next ?

                      The "agreement" to my eye seems to be an application form and is " short " on terms and conditions.

                              It is a credit agreement and appears to be copy of the original. They have missed a bit though ( if you read these bits there should be another section called OTHER TERMS)

                                So you should reply to them and state they have failed to fully comply with your section 78 request and could they send you the other document referred to in the agreement so you may fully assess your position.

                                (1)The creditor under a regulated agreement for running-account credit, within the prescribed period after receiving a request in writing to that effect from the debtor and payment of a fee of [F1£1], shall give the debtor a copy of the executed agreement (if any) and of any other document referred to in it, together with a statement signed by or on behalf of the creditor showing, according to the information to which it is practicable for him to refer,—

                                (a)the state of the account, and

                                (b)the amount, if any currently payable under the agreement by the debtor to the creditor, and

                                (c)the amounts and due dates of any payments which, if the debtor does not draw further on the account, will later become payable under the agreement by the debtor to the creditor.
                                p.s. it doesn't matter if it is an application form or not, many agreements are application forms which are then executed on acceptance.
