    They would want the solicitors fees and court costs as well, but you can always negotiate with Bryan Carter as settlement you are both happy with on the basis they discontinue the claim.

    What happened since receiving their new particulars - did you enter a defence against them ?

      hi thank you for your reply they haven't entered a defence yet but i did ring the courts and they told me they have paid the hearing fee

        You put in a defence on 19/4/2015 and the result of that was the claimants were ordered to do a new particulars of claim. Were you meant to submit a new defence based on those new particulars , and did you ?

          oh yes and i did sorry but there new particulars was 7 days late as to the court order and i hand to pay for postage as they didn't but the right amount on ,did send a letter to the courts to be struck out , but all i got back was a court hearing date .

            Was it just a letter you sent to the court to strike out or an application ? and is this hearing for that application ? ( did you pay £155 )

                help please , have paid the claim off they have cashed the cheque 4days ago and funds have cleared, we are in court on the 4/12/2015 tomorrow but they have not told the court that its been paid , what can I do .

                      It was/is Carters responsibility to vacate the scheduled hearing.
                      Have you told the court about this?
                      If not e-mail the court now if you can't then 1st thing tomorrow am.
                      Are you far from your local County Court Hearing Centre?

                        hi have rang the courts and they said they have not heard for carters , and I should turn up a court tomorrow , I did send a letter to the courts saying its paid and a copy of the letter and chegue I sent to carters ,

                          If you can get to the court do so and take the letter etc. with you.

                                I think your right , I have all the letters I sent carter and the courts and the bank statement showing payment was made , I will take that to court tomorrow .
