help please , have paid the claim off they have cashed the cheque 4days ago and funds have cleared, we are in court on the 4/12/2015 tomorrow but they have not told the court that its been paid , what can I do .

It was/is Carters responsibility to vacate the scheduled hearing.
Have you told the court about this?
If not e-mail the court now if you can't then 1st thing tomorrow am.
Are you far from your local County Court Hearing Centre?

I have sent the courts a letter with a copy of the cheque and a covering letter stating it was paid but they still say its down to carters to stop the hearing

so ... what happens now Nem?? If BC aren't telling the courts it's paid and the courts aren't accepting AC's proof????

As said it is Carters responsibility to vacate the hearing, the judge wont
be impressed.
The court is sticking tight to the rules.
If you can/do go and it cost you money you cold try asking the judge
to order Carter to pay your costs of attending.
I have known Carter to Fax a discontinuance on the morning of a trial.

hi well the judge said that the claimant has not said its paid but I showed him the paper work I had to say it was , he didn't really look at it , all he said was I give the claimant 4 weeks to tell the court they are happy with payment or not , also the claimant sent all there paper work in , but I have not seen any of it . so me not happy

OK s Carter did not attend or send a representative?
I personally would be making a Formal Complaint to Carter. and seeking redress for lost wages etc.

hi no one attend or sent a representative , I did say to the judge that they could not be bothered to turn up ,and all he said was think you self lucky as it could cost you more .

Ok mid week if you here nothing check with the court again the judge it seems has stayed the claim.
All down to Carters incompetence!
