The debt is £954, yes I have one final bebt in the background which has just changed hands, although this one needs my attention at the moment, yes I pay rent, council tax,water bills,electric, and have 2 children & in receipt of tax credits,no arrears all up to date!
So.. Looks like this Tomlin order is the answer here, how do I go about it?

Do you have other debts as well as this existing CCJ and this new claim? Do you have any priority debts - rent/mortgage arrears, council tax, etc?
Are you renting or buying?

My thought is IF there is no other line of defence now SB is no longer an option, lean towards an #
agreed reasonable, affordable and sustainable offer of payment secured by a consent (Tomlin) order.
No CCJ is given as long as the repayments are maintained.

Thanks to you both DC & nem, looks like the SB I thought was the case is now a no no!

Its looks as though you have bought something with a one year interest free period at the start. If you pay it in full during this time no interest is added. If you don't then you have to make 48 monthly payments starting jan 10 and ending dec 13. Does that ring any bells?"This is a 48 month agreement payable either by a first instalment of £16.02 on 8/01/2010 followed by 46 monthly instalments of £16.02 payable on the same day of each month, and a final instalment of £16.02 on 08/12/2013 or one payment on or before 01/01/2010.
If this is the case - and it looks pretty normal to me - then you can't use statute barred as a defence as the 6 years doesn't start running until you have missed a payment.

Very much in demand, so....what do u make of my recent post regarding the dates of the signed agreement, has this photo copy be tampered with or do the dates make sense to you, just wondering why it was signed by myself in Jan 09 & first payment due Jan 2010. The reason I was going for the SB was me seeing that it was signed in 09, but if first payment was due in 2010... That would blow my claim out of the window I suppose?
