Re: BW Legal/Lowell Portfolio Court Claim

Ok these letters do sound odd it would certainly be interesting to see them.

Hold on to those cheques!! and the letters.
I'm guessing these may be " unlawful" debt collection charges added at some point.

If the hearing fee hasn't been paid then the court usually give them a further 7 days to pay it or strike out the claim.

I got the letter but it's come through really small, have replied to your email anyway xx

I'm sorry that we .................................... transfer charges in the .... and this is to let you now that we are committed to putting this right by refunding the fee and making a compensation payment to you.

You're a star.
The bit that's missing is
I'm sorry that we applied these types of transfer charges in the past and this is to let you know that we are committed to putting this right by refunding the fee and making a compensation payment to you.
Just wondering do the courts give them an extra seven day just to allow for any back log?

Call the court again next week and ask if they are striking the claim out due to not having the hearing fee.

This transfer charges issue is interesting. FlamingParrott do you know where that other refund/compensation case is?

That made me chuckle Amethyst, it's not really fair though To give them extra time. Surely a due by date is a due by date as many of these companies would tell you if you asked for a week longer to pay oh then they would slap you with a late fee lol.
I'll call them next week to find out and is it worth mentioning to the court that since the claim came though I've had no correspondence from them at all despite requests. I've not even had the bog standard replies to my letters - nothing !!!

Well that sounds quite positive towards your chances of winning the case - though yes it is a bit unusual. The court won't really be interested ( well the Judge will be but the helpline staff won't at this stage )

When do your witness statements and whatnot need to be in ? mid august ?
