Re: Apparent CCJ from BW Legal

We do have a deed poll. I assume a photocopy would be acceptable? We can do that on the printer and can always e-mail a scan if required.

Yes a photocopy should be plenty, it's just to back up what you are saying save them coming back and asking for it later.

Alright. Poor printer is going to be working overtime today

So 3 CCA letters, DPA letter and letter to BW legal. 5 letters, 3 or 4 postal orders (will double check that in the previous posts) and all sent out signed for if possible to ensure they actually get them.

Re: Apparent CCJ from BW Legal

          Have removed "I will be applying to the County Court to set aside the default judgment under CPR 13;

I will forward a copy of my application to set aside the judgment under separate cover." from the BW legal letter, so we're talking to them first

EDIT: I've also been smart and uploaded all the documents to my Google Drive (set to private as hell) so I have a backup no matter what.

All letters printed, sent with deed poll copies, Postal Orders where appropriate and signed for so I can verify if they've arrived or not.

You are a star. That should be ok until the New Year now and we'll put the application in to Court then

Hope you both have a lovely Christmas and do try not to worry over this too much:reindeer: xxx

You too, and thank you so much for the help thus far.

Other half is obviously concerned, but not worrying about it since she knows I'm dealing with it... so she's happily wrapping presents.

Re: Apparent CCJ from BW Legal

Well, we got home today to find another letter from BW Legal.

It's the exact same letter I've posted here, except dated 3 days later (so 19th december instead of 16th), and I received the original on the 20th. I'm pretty much just ignoring it, but it's been filed with the other letter.

EDIT: My mistake. They changed the date the payment is due, so it's 9th January instead of 3rd January. Otherwise the contents are exactly the same.

Yep. Everything was ignored for christmas and we just relaxed with my parents. I've just told her it's all under control and we have to wait.

Re: Apparent CCJ from BW Legal

                        Got a reply from Lloyds.

Both requests have been refused due to the change of name, and they require a certified copy of the deed poll., either by going to the bank and getting THEM to take a copy and certify it, or they can send a parcel to the bank and my fiancee has to go pick it up with proof of who she is... which she doesn't have since she's not allowed to drive for medical reasons (so no driving licence) and has no passport.

Get to the bank? Probably. Would mean a trip into the city and I'll likely have to re-print off the letters and take them with.

It's just getting the other half to agree. She damn near goes into a panic attack whenever Lloyds are mentioned due to issues in the past.

Okay, got a letter from BW Legal. Taking out the personal details, this is what they said.

"We write in reference to the above matter and your correspondence received on 30 December 2014.

The current Bal;ance Due on the account is <amount>. We conform that no interest and charges are currently being applied towards the balance due.

A County Court Judgement has been obtained under Claim number <number> on the 4th December 2014 at the Northampton County Court Bulk Centre.

In regards to your request for the County Court Judgement to be set aside, we will not be making any application to set aside the Judgement due to our action being regular and in line with the County Courts. However we will hold the account for a period of 30 days to allow you sufficient time to seek independent legal advice and to put forward your proposals in regards to the above matter."

I'm... guessing that's a good thing? I'd argue their actions haven't been regular and in line due to a complete lack of communication prior to receiving the CCJ letter (which I did state in my letter TO them), but apparently they don't care about that bit.

Okay, in that case we best get the application to set aside the judgment sorted out. Did you manage to get in to the bank at all?
