    Not been able to get to the bank. I need the other half for that and she hasn't been well the past few days.

    I'm going to try and see if I can get her to go out tomorrow morning. We found a Lloyds bank about 10 mins walk from our house, so that makes things a LOT easier.

      I dont know why you let it get all the way to court. This is an injustice to a vulnerable adult.

      Your defence would have been absolute, the defendant lacks capacity and therefore any contract would be null and void. The claimant has been told this on many occassions. Then just run with that till march this year and NO LEGAL ACTION COULD have been taken the debt would have been statute barred and unenforcable.

      You should appeal, this time get mind/rethink to help you fully in the appeal, they will demonstrate the defendant does not have the capacity to follow what is going on in court, was co-erced into an agreement made by her ex or husband or whatever and therefore the judgement was wrong as you didnt have the full knowledge to correctly defend her. And she was certainly unable at the time to defend herself.

        If you read the post, you would know that my other half was acting on the advice of the CAB (ignore it) and the first we heard about it going to court was a letter stating "We have a CCJ against you."

        Hence why it is being dealt with NOW. Also, her ex-husband promised to deal with this 2 years ago (nearly 3 now) since the debt is also in his name. THAT is why it got all the way to court.

          Sorry i misinterpreted what you had written, i see the situation now.
          It doesnt really change my reply tho, she is certainly a vulnerable adult, and is lucky she has people like you to help her.
          And i still think you should see what legal options are available to have the ccj against her removed.

            Hi blanker, Khaine is just sorting out so he can act for the defendant and then will be making an application to set aside, (being as the claimant have unsuprisingly refused to set aside) so now documentation can be gathered and a defence entered against the claim. xx
