  • County court Claim

    Hi, Received county court claim form from Bryan Carter on behalf of Lowell Portfolio. Its re mobile phone bill from 4 years ago. I dont owe anything as I have paid bills and keep record so sent acknowledgement form to the court that I will defend. Court replied that It has not sent that claim form and that I should contact Lowell portfolio directly.

    What should I do? Where do I send the defence form?

    Any guidance will be appreciated

    Very suspicious, can you post up a scan or photo of the claim form please. Cover/edit out any personal details such as your name and address.

        Could you scan a copy of the reply from the Court please. Which court did you send the acknowledgement to ?

        Also have you tried logging in a MoneyClaimOnline with the details bottom right of the claim form ?

          Hi, Is it possible that there could have been some charges left after the account was paid off e.g. cancellation fees, or a final bill?
          There are so many small amounts " left over" at the closure of Mobile phone service contracts more often than not the service provider
          makes no contact about these and just sells of the "alleged" debt, often the amounts are under £100.00, the lowest I've seen so far passed
          to a DCA is £2.20.
          The problem arises because the service providers sell on a "portfolio" of delinquent amount which contains very small and very large outstanding amounts.

            Court's reply was:

            “Our computer system shows you have filed an Acknowledgment of Service which would have come with the claim form and the response pack and states what the particulars of claim are and who the claimant is.

            However I have indicated below the details and you will need to contact the claimant and their solicitors regarding this matter as it is the claimant that has issued a claim against you not the court.

            Please see the contact details for the claimant below as requested.

            Claimant name: LOWELL PORTFOLIO I LTD

            Solicitor name: BRYAN CARTER SOLICITORS LLP(1564)”

            I sent the acknowledgement form to the address on the form. Received an email reply I pasted above.

            I had direct debit payments through the entire contract period.

                  You need to register there first at https://myaccount.gateway.gov.uk/Pages/Registration/RegisterWithUserId.aspx?role=i&cks=1

                  Once registered you will be able to access that claim

                            Yes, but they replied and said they had not sent out the form, the claim has been lodged online, so you should acknowledge and indicate you intend to defend online too. Nothing other than that yet.
