    Totally agree! Literally 1000s of posts about them on consumer websites!

        Hi Amethyst,

        I received the documents to strike out the claim from the court. They are stating the fee is £155? How should I word the response to Q10. What information will you be relying on, in support of your application? Should I say the evidence I have already submitted in response to their claim? Should I state that I want it dealt with without a hearing?

        Any advise as always greatly appreciated.

          Yes £155 is the fee for the application ( which is why it is worth writing to them in the first instance ) - you can apply for without a hearing which would be £50.

          If you are on a low income or certain benefits you may be entitled to fee remission

          Do you think I could just go ahead and tell them that unless they respond within 7 days that I shall be putting in an application as they have already not responded to either myself or the court?

            I have not contacted them again yet. I had a letter off them it states:

            We refer to our previous letter dated 28/10/2014 and confirm we still await receipt of copy documentation from the originating creditor.

            We acknowledge receipt of your request and wish to assure you that this has not been overlooked. Upon receipt of the relevant information, the same will be forwarded with immediate effect. The account will continue to be placed on hold pending the documentation.

            Should you wish to discuss this matter with Arrow Global in the interim please contact us on the number below.

            I shall email them back and tell them I am going to apply for the claim to be struck out seven days from the day I send it.

            What information should I write in a letter to the court in the hope that I won't have to put in an application?

                    I have received this via email this morning. The first letter is redacted and am I right in thinking that the agreement is state barred? How should I go about this now, with regards to the court?

                              All they said is: Please find attached herewith:
                              Default Notice
                              Original agreement with Sainsbury's Bank, as requested.
                              An an apology that it has taken so long.

                              They obviously don't have the original Default as they didn't redact anything on the agreement. I would guess the last payment was some time around December 2009.

                                Statute Barred is out.

                                That agreement - it states on it you have received, read and agreed to the Conditions of Use. There are no conditions of use with the agreement. And they form a part of it - so you should respond and ask for the Conditions of Use which form part of the agreement and question where the The IMPORTANT FINANCIAL INFORMATION comes from as it doesn't look like it goes with that agreement at all. Also ask for latest terms as varied and a signed statement of account to fulfil their obligations under the consumer credit act.
