          Update and any further advise greatly appreciated.

          I have contacted the court and the claim has been stayed. However, the court has told me to keep calling to check on the status as the claimant can get that lifted at any time. He also said that they could then proceed without me knowing.

          Is there any way that I could have this thrown out at this stage? If so, how would I do that?

          I had an email just before Christmas from Arrow Global, in response to one I'd send months ago. They stated they are waiting for the paperwork. I guess they mean their proof!

                  Ahh right, I think we missed a little bit - did you get a defence put in before the end of the extension period ? then they haven't replied to the defence within the 28 days and the court has put the case on hold ?

                  If so you can apply to the court to strike out their claim as an abuse of process - you could try just writing to the court first but it is likely they will come back asking for an application.

                  You'd need the N244 application and it would cost £50 but you should be able to get that back from the claimants. It is an idea to write to the claimants first and ask them to discontinue to save time and costs as you will be putting application in in 7 days, unless they send you the documents required etc.

                    Hi Amethyst,

                    Yes, the defence went in, I ignored the so called extension as when I contacted them they did not confirm it, in fact they have only responded once to an email and that was two months after I had sent it.

                    When I called the court they said they had had no communication from Arrow Global. They suggested that I contact them and ask what their intentions are. I did this before Christmas and still have not had a reply.

                    Do you think I could just go ahead and tell them that unless they respond within 7 days that I shall be putting in an application as they have already not responded to either myself or the court?

                      In that case yes I think you have had plenty of time and you are quite safe to give them a nudge.

                      There's always the risk they could suddenly find all the documents but then at least it isn't hanging over you indefinitely.

                        I don't know what is going on with AG and litigation there are so many case such as this in " limbo" at present, it does make one wonder if there are changes afoot. (perhaps linked to the failure of Erudio in which AG is involved_?.
                        7 days notice for strike is the way forward.

                            Companies House is minded to " strike Off" Erudio for accounting failures.
                            Erudio was formed by a " consortium " of debt purchasers to acquire the accounts of SLC.

                              I thought erudio had filed their accounts late and that was resolved now? Or can action still be taken?

                              Been fighting them for months and they are not fit to handle the deferment process as they have a vested interest in making people pay up when they do not legally have too.

                              Would love it if they were stuck off but can't really see it happening.

                                I believe there are other problems to be addressed.
                                I think personally Erudio has failed its remit and is to say the least ineffectual.
