    Well, amend it to suit your circumstances as I have just gone off the info in this thread, first.

    Once submitted to court it will be sent to the Claimants, and they will have 28 days to respond to the court to say if they wish to proceed. At that point you will receive a direction questionnaire, or the Judge will make directions based on the lack of info off his own back. Then you can get the case allocated to your local court and there will be an exchange of witness statements before a hearing. In between all of that though the claimants will need to provide evidence of some kind that the debt is yours, is the right amount etc, and you'll have opportunity to mediate and negotiate if you want to settle at any point. Really the defence is testing the water and you have to take it step by step seeing what they come back with and reconsidering your options the whole way through.

        Shouldn't be.

        If the claim was issued on the 10th October you should have till the 12th November to submit it.

            I've just sent the defence statement off electronically and I have noticed the court closes at 4pm will this matter that I sent it after 6.30pm on the last day? It says it will be processed the next working day,

              Should be okay as the claimants wouldn't be able to file for default judgment until tomorrow anyway so you having submitted your defence should barr them from doing that

                    That's standard procedure, they have 28 days to say whether they wish to proceed with the claim or not. If they don't respond the claim is stayed.

                    You just have to wait for their response (or lack thereof). :ranger:

                      Hi all,

                      I had a letter yesterday dated 5th Dec from Capquest's 'solicitors' Drysdenfairfax where they say;

                      "We write with reference to the above claim recently issued against you and acknowledge receipt of the defence filed in Northampton County Court Bulk Centre.

                      We are currently seeking our client's instructions and will write to you again upon receipt of the same. No further action in respect of this claim will be taken until we have our client's instructions.

                      Should you require any further information...

                      Does this mean they don;t have the information I asked for and they are stalling? The defence statement was sent on 12th November electronically and I'm pretty sure the 28 days have now elapsed. So what does this mean..?

                        It does sound like they can't come up with the goods as expected.

                        If they don't respond to the court in 28 days saying they wish to continue with the claim, it will be stayed, it looks like it's heading that way.

                          So they have 28 days to respond to the court from the 12th November? That time has elapsed I think. Would the court write to me to tell me that they have received a reply from the claimant and what the outcome is? If it is stayed does that mean it is the last I will hear from it and that no judgement will be entered into in the future? Thanks

                              Hi all... Happy new year!!!

                              I haven't heard anything back yet so does this mean it has beentayed and will I get notification from the courts? What does this now mean? Can I also ask for it to be removed from my credit file?
