    no if they have not responded in the CCA1974 request time they are in default,

    Lowells would love you to be nice to them as you will be seen as a roll over and easily conned, they are crooks of the 1st degree they make people homeless for their greed

    have you not sent CPR request ?

          you have made request it is up to them to respond, it would pay you to find others lowell threads and see that they play games hoping you give in even up to the last minute, see the system they tend to use from those threads

            FP has advised on the CPR request:-



            They should respond to the CPR request in 7 days. When they're up, start chasing them, send them an email, then ring them up.
            :cell: Ask them to agree to an extension of 28 days which is the maximum allowed under CPR15.5. Keep an eye on the timescales, remember unless they agree to an extension, you have a maximum of 33 days from date on claim to submit a defence.

              do not be sucked into any other subject if you phone them stick to the relevant query, do not tend to show you may be a soft touch. be polite but firm in the request!

                Thank you Mike, I will be giving them a call Monday or Tuesday to see what is going on and to request the extension.

                  Ok, Ive just sent an email asking them to respond to my CCA request or agree to the 28 day extension... How long should I allow for a reply?

                            It's fine, seriously, don't panic, really you WANT them not to send you any evidence or documents.

                            You can start putting together your defence if it is driving you bonkers twiddling your thumbs waiting for them to reply.

                                Thank you, What kind of information do I need to put in my defense? Im going to have to send it via snail mail now as it wont let me log into the money claim site for some reason!

                                Acknowledge Claim - within 14 days from Service

                                Defend Claim - within 28 days from Service (IF you acknowledged in time)

                                If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
