        Hey, I had a reply from bwlegal saying that they are awaiting the documents for the CCA request from their client (Lowell)
        They are taking their time. I've sent my defence by post today so hopefully it arrives at the court in time. I will report back when I hear back!

          Well I've just got home from work and it looks like they are going to respond to my CCA request, trust opened letter and its a statement of account would it be any use if I post it up?

            Sorry Phil I wasn't around yesterday - did you get your defence sorted okay ?

            If they just sent you a statement then that isn't complying with your CCA request yet, no need to post up unless there's anything you aren't sure of on it.

              Ok thanks,
              I was looking through the statement and for some reason their is lots of £25 charges right at the beginning of the agreement when I never missed any payments at all? Also the last entry says write off with a balance of £0

                Hi,
                I've just recieved a letter from bwlegal in response to my defence stating that their client Lowell wish to proceed with the claim, that is all that the letter stated. What should be my next course of action? Should I consider now making an offer of repayments avoid getting the ccj as it seems they aren't going to let this go? They havnt complied with my CCA request either apart from a statement of account

                  They haven't complied with your CCA request - that is the main thing.

                  BW often send you the 'we'll tell the court we wish to proceed' letter then do nothing, or do proceed right up to the hearing without producing any documents. As long as they have not provided the CCA I would continue. If they provide the CCA THEN would be the time to consider a settlement.

                  I would like to see a copy of your first couple statements btw with the £25 charges on, and a copy of your defence if you don't mind posting it up, just to make sure you pleaded the right stuff on the CCA.

                    Hi Amethyst,
                    I'm away for the weekend but will get a copy up ASAP. I hope they are just trying to scare me into paying, surely if they have an agreement they would of sent it by now. I basically used a template off of the forum for non compliance of CCA request ect.

                      Ok that's fine then xx Yes they are just trying to scare you into paying as they can't get your credit agreement and know they can't get judgment without it. So you will either hear nothing now, or get a directions questionnaire from the court.

                            Ok, I've just recieved my directions questionaire today, do I agreed mediation? What else do I need to include with this? I am going to try and get the scanned documents requested onto here but my printer has broke!!

                              Only if you would like to explore the possibility of settling this before it goes to court, otherwise if you are confident about defending it, it's not necessary to agree.

                              You don't need to include anything at this stage, just answer the questions and return it as indicated. The court will then issue directions to both sides.

                              What documents are you referring to?

                              An alternative to using the scanning facility on your printer would be to take a picture using your mobile phone or tablet. hoto:

                                I'm not confident at all to be honest, I don't have a clue what to expect in court or what to say, if they will turn up even. Actually quite worried!
                                Amethyst wanted to see the statement of account they sent me with lots of £25 charges that shouldn't be on their, and also my defence statement which I just remembered I wrote by hand due to no printer lol.
