  • ccj Lowell/Bw legal

    Hi everyone.
I recieved an N1 ccj claim form from Lowell/BW legal for a debt that I had with British Credit Trust that I took out in October 2008 which I defaulted on in August 2009 with no further contact or payment. I have checked my credit report and the British Credit Trust account is still on their and showing it as VT in December 2012. I can't see anything on their showing the debt is with Lowell. Why would this be? Would they have any claim on this if not reported?
Anyway I have sent a CCA request to them today to help me with my defence case as I have extended the 14 day period. Is their anything else I could use in my defence case as I really don't want a CCJ after working so hard to repair my credit history!
    Thanks in advance
    Phill

You have acknowledged the claim, send a CCA request, you could also send a CPR request to the claimants solicitors.... http://www.legalbeagles.info/forums/...ic-information
Ask for the agreement, terms, notice of assignment and default notice

                        Hey,
Thanks for reply.. I've sent the CCA request but sent it to Bwlegal as on the claim form it says send all correspondence to them? Should get to right place eventually I guess. How long do I have to wait before the next step? What would my next step be if they provide requested details or if they don't?
                        Thanks

It should, they should forward it to their clients.

They should respond to the CCA request in 14 working days but chances of that happening are extremely slim. There's no need to chase that one, as non response can be used in your defence. :thumb:

They should respond to the CPR request in 7 days. When they're up, start chasing them, send them an email, then ring them up. :cell: Ask them to agree to an extension of 28 days which is the maximum allowed under CPR15.5. Keep an eye on the timescales, remember unless they agree to an extension, you have a maximum of 33 days from date on claim to submit a defence. :clock: If they agree to an extension, forward the document/email to the court. :typing:

In the extremely unlikely event they do provide the documents, just post up here.

                          Keep us updated.

I've been looking at my credit report with 2 companies. The last update for this account was on the 1/12/2012 which is showing it as settled with a £0 balance?
Could I use this info for defence at all? The account is not present with Lowell or any other company on my credit report
