Hi Moneybear, sorry to have missed your posts, just for future ref its always fine to pm someone to bump them to look at your thread.

Where are we with the court claim ? HAve you had the direction questionaire yet ?

Yes we should definately bring up the false credit agreement with the court, just need to suss out exactly where we are and we can work out whether to amend or go on witness statements / writing to claimants etc.

thanks for for the reply and info about being ok to pm.

I have written back to the solicitors, pointing out my reasons for believing the agreement may not be a accurate reconstituted version.

I haven't heard anything back yet, but crossing in the post to me was a more legible copy agreement and copy of every monthly statement, they also sent me an income and expenditure form and asked me to send them a proposal for repayment.

I thought I would send them a copy of my latest stepchange budget as this follows the stepchange guidelines on limited expenditure, but wondered is this normal for them to try and get a proposal for repayment outside the court, or does it suggest they have reduced confidence in the documentation they have?

Okay so you are still waiting for the claimant to tell the court whether they wish to continue.

I wouldn't send them any thing at the moment until we've sussed if the agreement is legit or not.

This bit

I have already noticed that the agreement appears that it could be for a football club branded credit card (mine wasn't a football club card)

is that clearer now you have a more legible agreement and is it still the case that it is not the correct version for the card you had ?
