  • Sygma Bank / Drydens Claim Form

    I have today received a claim form from Northampton for a credit card debt owed to Sygma, taken out in 2008 current balance is approx £3k

    This has been on a dmp with stepchange since 2009 however I have recently had to reduce my hours of work to care for my wife who has a lifelong illness and they are obviously not happy with the new token payments of £1 a month

    The amount claimed is slightly more than stepchange have the balance as but is within a couple of hundred pounds (I guess extra interest?) plus fees and costs.

    I assume the first step is to acknowledge the claim at moneyclaim.gov.uk

    since i acknowledge that I owe the money and have been paying via stepchange since 2009 is there are reason for me to send a cca request and CPR request or just complete the N9A for with an offer of payment?

    I would send the CCA and CPR requests, and say you intend to defend in full on the acknowledgement ..... if they come up with the documents then you can either submit your admission and offer to pay to the court or try and negotiate with the creditor - court sounds the best way if you are already on token payments due to your circumstances - if they don't come up with the documents then you might be able to defend.

    Do you own your own home ? Just checking what possible consequence of a CCJ might be for you before going down the admission route.

      Thankyou for the reply.

      Yes our home is on a joint mortgage, this CC is only in my name, I assume they are probably after a charging order rather than accepting token payments.

      I imagine that since Sygma bank have never sold the debt on they are perhaps confident they have the documentation.

      Anyway, I will get the acknowledgement done tomorrow and prepare the CCA and CPR requests and report back here

          Just to update, I have acknowledged the claim online. Also posted off the CCA & CPR requests recorded delivery.

          I will post back again when/if I hear something. Thanks for the help so far.

            Ok so time for an update...

            I have received a printed copy of the CCA following my request, this is a generic form with my name and address hand written over the top by them.

            I have also received from the solicitors acknowledgement of my CPR request which they have forwarded on and have said they are putting any further action on hold until they can fulfil the request.

            So ...

            The issue date of the claim was the 28/08/14, I assume that if I have heard nothing by the middle of next week, I need to think about filing a defence that I have not received all the information I have requested?

              Ok, so nothing arrived in the post today,

              Even though I have it in writing they are not taking further action till they have the paperwork requested in the CPR request, I assume it is still wise to file a defence saying something along the lines of the documents I have requested have not yet been received?

                You could at least get one written up .... when is the deadline for submitting your defence??

                  The claim was dated 28/08, so 33 days is 30/09

                  As mentioned earlier in the thread I have been paying this card via stepchange since 2009, I assume they have decided they would like to go for a charging order, hence the Court action.

                  I cant decide if I should just make an offer of payment now, or put in a defence saying they haven't provided the requested paperwork.

                    Just to update, I did put in a defence saying the documents had not been received and the court responded saying they had 28 days to contact the court about my defence before the claim will be stayed.

                    However..

                    Following my CCA request I have received a photocopy of some agreement from Sygma with my name and address added on, Im fairly sure it isn't even a copy of the one I completed originally, just for another creation card.

                    Today I have received from drydensfairfax a letter with an illegible copy of a CCA, it appears to be the same random creation card CCA which my details have been added to.

                    They have also sent a copy of the default notice as requested.

                    They have mentioned in their letter that their client does not hold a copy of the original agreement, but a reconstituted copy satisfies the requirements to evidence a claim against me.

                    I will try and scan everything up later

                      Hi reading through the notes you say that the credit card is with sygma I've never heard of sygma before. Are they similar to Capital one also were you paying any PPI on your credit card have you had lots of late payment charges etc?. Legally you can only pay a £1 on your credit card if you are in financial difficulties telephone the national debt line on 08088084000.

                            Yes, as mentioned earlier today, following my CPR request I have a reconstituted agreement which I will scan up when I get home later.

                            I have already noticed that the agreement appears that it could be for a football club branded credit card (mine wasn't a football club card)

                            I have noticed that at the bottom of the agreement is a section for completion by store staff ( assistant number, first purchase amount etc) My card was not applied for instore.

                            Im fairly sure that this is just a randomly selected creation agreement ( The solicitors have admitted they don't have the original agreement)

                            Does anyone know, should I be going back to the solicitors/court to say I don't believe this is the correct agreement?

                              I have finally managed to scan some of the documents received :tinysmile_twink_t2: (removed my images while I decide what to do )

                              The copy of the agreement received from the solicitors after my CPR request is not readable...

                              However the version from my CCA request is larger..


                              I also have copies of the terms, default notice and letter from solicitors saying they do not have the original agreement, which I can upload if necessary.
                              For a couple of reasons I don't think it is atrue copy of my agreement.

                              Should I got back to the solicitors/court and say I do not think this is a true reconstituted copy of my agreement??
