Re: Identity Theft Fraud Theft, lead to CCJ and Charge register on my Joint property

Well unfortunately for Link and Sainsbury's they have no choice. If you submit a formal Subject Access Request they have to abide by it and send you everything they hold on you. This might help you see what;s gone on with the case.

Unfortunately CCA requests for copies of the agreements are unlikely to bring anything up as they already have a judgment. But worth a try in my opinion.

Also do you know who the original creditor of the debt that was sold to Link Financial was ?

Can you also give us an idea of dates here. When approx were the CCJ's awarded against you? (when were they entered on your credit file )

Given the history and nature, I would be inclined to report the matter to Action Fraud. Click on the AF logo on the right-hand side of the page.

Incidentally, what sort of figure are we talking about in total?
Life is a journey on which we all travel, sometimes together, but never alone.

It is essential that this is done as soon as possible. The CCJ cannot have been recent if they have managed to get charging orders. The court can decide to not set aside a judegment if you appear to have delayed in applying for it.

If you have a tenanted property then you must surely be able to pay the court fees? If you are on means-tested benefits you may get fee remission.

The Police new about the matter already. About £18,000, it would have been more, if I had missed one of the Court hearing

Have you had a look at the EX160 ? You could be eligible for fee remission, its worth looking in to.

Customers wishing to apply for a remission must use the following forms and leaflets.
Court and Tribunal Fees - do I have to pay them? This leaflet includes the EX160 Application for a Fee Remission Form.

Undertaking to apply for remission of a court fee or tribunal fee, or to pay a court fee or tribunal fee for emergency applications only

              Fee remissions contribution calculator (Excel)

What's happening with the police investigation?

And have you been to see Citizens Advice?

Police gave me a Crime reference number. They said because I didnt know who actually did the Crime and it came too my attention too late, they said I just need to inform the bank and that I shouldnt be liable." But it has not been that easy!
And have you been to see Citizens Advice?
I am actually getting more help here than Citizen advice. I know they do amazing work for people but they couldn't do much too help over this matter as the bank had alrready secured their charges before I was informed.

                  Yes I know the creditor.

these are the dates entered on the title deeds: Link Financial: 31:10: 2007 and Sainsbury: 05.05.2008
I am ready to go and Contest them now. They have destroyed my life enough!

Okay, as well as doing the application to set aside, I would get a CCA request off to the original creditor of the Link debt, and Sainsbury's, as well as a SAR to Link and Sainsbury's. In your set aside application put the crime reference number. We'll help you draft it when you are ready to do it.

The problem you might hit is the length of time since the CCJ's. When did you first find out about these two ?

I didn’t find out until after they had put the charges, after few years. In that amount of time, I have dealt with various challenges, and I have attended court for one. My co-owner of the property new first, after he suddenly received a letter from the Land registry and he immediately contacted them but at that point, they had already registered the charge. He was also a victim too but he was extremely proactive with his own issues and not incur any. They were not very accommodating to hear my issue, because it was already slipped through, so they wont do anything about mine and the solicitors charged so much to write just one letter. A phone call to the bank or land registry, could send me off for months into stress. I went through a relapse of depression and it became chronic after attending the court hearing during pregnancy on my own and then loss a family member to ferocious cancer etc so I was told to stay away from anything that could instigate the depression until I am totally able enough to deal with sensitive issues.
Now, i have nothing good going and if I dont use all my energies to fight this, I am just going to be completely ruined and let these evils, horrible, nasty and wicked criminal destroyed my life.

Thank you so much. I think I am ready to deal with it now. What is CCA request? and SAR?
Please help me in drafting the letter?

Sorry for my rant, It easier for me to write it down than speaking about it, because speaking about it, brings bad memories and it is my worst nightmare.
I just wish I could know the filthy people and the bank that did this to me..so they can feel my hatred!!!
