    Have they sent you anything else other than what is in that email ''bundle'' ? Such as current terms and conditions, statement of account, default notice etc ?

              Did you give the court a call to ask for the terms of the judges directions? Just so you know exactly what you have to do.... Skeleton Arguments by 6th June I think... is that all?

                  Okey doke we need to have a new look over everything now.

                  The bounced DD in November and the debit card payment in December worry me. Also despite those it appears that DD payments were made up until October 2007 - and with Statute Barring - it would need to run from the point that you could have been defaulted on the account, which wouldn't have been until at the very earliest 9th November. So I do, sorry, think that the Statute Barred defence is kerputt.

                  PT and M1 did have some thoughts on the Credit Agreement, I am concerned they are fixable technical points, but it is worth looking at further.

                  Bearing in mind your desire to keep away from having a CCJ against you I think the option of negotiating a settlement, either reduced full and final, or installment under a Tomlin Order (so the case is stayed in court and you don't have judgment against you - unless you miss payments when they could then apply for judgment) should be considered if at all possible.

                    how little a payment do you think i can get away with? Its most if a months pay at the moment.

                    Do you think theyd pull the DD payments out of the hat at the hearing then?

                    but also isnt the acct in dispute as i had requested CCAs twice in the past etc? 2010 for example.

                      Did you send £1 and a cca request to anyone ? What was sent back ?

                      Did you get a default notice ? They say you did and if so a copy would be nice in case it has errors.

                      Have you had a notice under s86c http://www.legislation.gov.uk/ukpga/1974/39/section/86C

                        I sent a CCA request in 08, 2010 and then a follow up letter in 2010. Then a CCA request again in 2013 when these proceedings started.

                        In 2010 i had an acknowledgment letter from lowels, but never heard again untilthe court papers arrived.

                        I dont remember getting a default notice, certainly havent seen copies of anything, only what was sent in the email bundle on thursday

                        i dont recall any letters about 'sums in arrears'

                        May 2008
                        april 8 th 2010 then the reminder in sept 2010

                          I also sent an SAR and a £10 PO to cap 1. Never heard from them. Again this would have been in 08.

                          i dont believe lowells didnt take assignment until 09.

                            Morning everyone, blardy hell where this rain suddenly come from? Utter pants, i sent the boy to nursery in shorts fgs!

                            I think tomorrow is the day i need to post off the skeleton argument, overnight deliv. I think to the court and the drydens lot.

                            And i never did receive the bundle in the post. I bet they didnt send it. But if they did, and its been sent elsewhere im going to be exceptionally unhappy about my confidentiality been spread all over the place like this.

                            Im not quite sure how to do a skeleton argument, can you help me set it out please? Thanks x

                              Evening all, hope all is well. I am going to try and bullet point an argument tonight, but indont know what to say anymore. Im worried about the payments made and might end up getting trashed over that
