          You have to put them to strict proof of those payments that they came from you and by what method, point out why you couldn't have made them.

          Also ask for adjournment based on their failure to supply documents as ordered (14 days before hearing) and that you are disadvantaged in only receiving them 'yesterday afternoon'.


          Could you type out word for word the order that mentioned the disclosure please.

            Blatantly fake schedules of payments seem to be becoming Lowells standard tactic with a SB defence.

              Thank you yes indeed. Also i will check my husbands diary, he will know exactly where we were on those days. I do know on the second date, the sunday. Inwas at home and inwas waiting for a nurse to come see me. She emailed me to cancel because her car was broken into. So the last thing on my mind would,be calling or taking a call from that lot.



              The first date was two weeks before i went in for my section. Theres a good chance i was at the hosp that day discusssing the c section. Again, why would i be thinking of lowels


              also, the so called LBA, well isnt that just disguised and hidden as a bog standard threatogram?

                I have years of statements with creditexpert...no payments have been paid for at least 60 months. It would show wouldnt it?

                  On the list of payments there is a payment method given by all the payments except the £10 and the £3.73 which happen to be within the stat barred period. They all state Direct Debit or Debit Card Payment, whereas the odd payments just say Payment Received.

                      If the creditor claims payment was made within the limitation period then the burden is on them to prove it.

                      Sadly some judges seem to get that the wrong way around and try to make you prove you didn't.

                        Looking at my creditexpert account. It does not show any payments made and reported to my credit file at all in the last 60 months. In fact only one figure is shown £694 for a month in 2012 or somewhere. No other figure.so it cannot show any payments being made.

                          CRAs records are often incomplete or non existent in terms of payment records/statuses. Plus on defaulted accounts the only evidence of payments would be the balance going down, as monthly payments statuses are not longer recorded after default. In other words, not in any way a reliable record of payments and you can't treat them as such.

                            Interesting jump aswell on page 13. New balance of 138. To 457. In a month yet the account shows no transactions.

                              Ah, it doesnt show any payment going down. If anything if shows the balance of having increased.which is where they have added their interest

                              i dont think those payments in 2008 are even genuine either. I was on long term sick, on benefits raising a child by myself. I wouldnt have given them anything

                                He total they are claiming cmes to around £14. Postal orders and SAR payment spring to mind...
