    Any Other Information or Background Details: Hi, I am helping family member to deal with their debt and court proceedings that have been started now. They have been burying their head in the sand for a long time now. They have main bank account with natwest and have gambling issues. originally credit card debt was around 4,5k but then all the interest was added and they lost their job. I have suggested as it is the main bank and all wages were coming in and all expenditure is there for natwest to see, to submit irresponsible lending claim to natwest directly. I have told them to acknowledge the claim on mcol today. They have spoken to solaris and arranged £50 a week payment plan but they are not stopping the court proceedings. Should they send the CCA request to natwest and CPR request to solaris law ltd ? Also if they choose to submit irresponsible lending claim due to gambling addiction should they add this on CPR request at the same time? Any advice is welcome, Thank you

    a) First Acknowledge Service of the Claim, you can do this online via MCOL, this will give you 28 days (plus 5 days postal) in total to work on your defence
    If the issue date is the 03/11/25, why haven't you Acknowledged Service of the claim?

    b) Send a SAR request to Nat West, they have 30 days to provide all the data they hold on the account. Make sure you get Proof of Postage.

    c) Send a CCA request to Nat West, they have 12 days to provide a copy of the original agreement. Make sure you get Proof of Postage.

    d) Send a CPR 31.14 request to Solaris Law, they have 7 days to provide all the documents they are relying on to make the claim against you, again get Proof of Postage.

    e) This is an example Defence, start looking at it, don't fill or file it with the Court or their solicitors yet.

    Don't speak to creditors, solicitors etc over the phone, everything in writing. Keep on top of this, especially dates for filing defence etc. Workout when your Defence is due, 28 days from the issue date on the claim form. If you can post on the thread 5 days before it's due we can help with your Defence.
