I've completed the AOS this morning. I will send off a SAR to Sky and and CPR 31.14 to TM legal today and keep proof of postage. Is it then just a case of waiting to see what TM Legal come back with?Originally posted by echat11 View Post

This is the particulars of claim.
The Claimant claims payment of an overdue balance in the sum of 667.87 incurred by the Defendant under a Communications Agreement with Sky, under account reference ............ The Defendant failed to maintain payments in line with the terms and conditions of the Agreement and the account was subsequently terminated. The account was assigned to the Claimant on or around ........... and the Defendant has been given notice of the assignment pursuant to section 136 of the Law of Property Act 1925 The Defendant has failed to repay the sum of 667.87 which the Claimant now seeks to recover from the Defendant together with applicable costs and disbursements.
In my CPR 31.14 Should I ask for thr below

Im also confused slightly about this bit in the CPR 31.14 request. In red it states the below
For your information and records I enclose a copy of the formal request for a copy of the credit agreement relating to this claim, pursuant to the Consumer Credit Act 1974, which has been posted to your client with the statutory fee of £1 today, xx/xx/xxxx.
Do I include the £1 postal order in the CPR to TM legal or is that for the SAR request. Also where it says ive included a copy fo the request. Does that mean I include a copy of the SAR request to sky when I send the CPR to TM Legal.

Your AOS gives you 14 + 14 from the issue date (plus 5 days postal) to get your Defence in.Originally posted by Davies84uk View Post

Yes, but note that a Defence needs to be filed in time, do not forget.

You don't need to include £1.

They should have responded to your CPR 31.14 request. The thing to concentrate on is when your Defence needs to be submitted.
How do I write a defense if they dont responded.
I did recieve another letter from them today but it just a repeat of before saying they've taken me to court and offering me 6 months to pay along with other options but nothing in terms of the CPR

Update the thread as you get information through.
Don't speak to creditors, solicitors etc over the phone, everything in writing. Keep on top of this, especially dates for filing defence etc. Workout when your Defence is due, 28 days from the date on the claim form. If you can post on the thread 5 days before it's due we can help with your Defence.
