Ok thanks, do you think I have a string case given the conduct of TM Legal to date?

The conduct of the parties isn't relevant to the facts, evidence in the case, it's a separate issue.

          That's a standard SMS.

The important communications are from the Court.

They've filed a claim with the Courts, so all the SMS messages are standard.

Ok I understand. But the fact they haven't replied to the CPR 31.14 would lead me to believe that they may not have the documents. They have also admitted they dont have them in the email communication today. As they said they were waiting on them from Perch Capital. So I dont understand how they could apply to the court in the first case when they never had the documents. Do you think I should wait it out a little to see what happens. Thanks

It's really up to you, but the these SMS are being sent 'frequently, so you could be right, a 'weakness' in their case.

MCOL only has basic information, it's not reliably updated. For updates, it's a 'bind', but call the Court.

You filed your Defence on the 5th Nov, you received confirmation on 12th Nov, so the Creditor should respond in
the next week or so. If they don't the case is 'stayed', that should be in your letter of 12th Nov from the Court.

Called the courts today and as yet they haven't heard anything from TM legal.

Clearly up to you, if you want to accept.

You need to remove the attachment, as it has personal details.

Not sure how I do that I can't see an edit option.

With regards to the offer i dont know as I still dont know what I owe them. I feel like they are grasping now to get anything as they don't have the documents.

I alert Admin, ask them to remove.

                                They seem to be desperate.

So, your minded at the moment to continue to defend the claim.
