    Hi all, was hoping someone could help. Ive had TM legal contact me over an apparent outstanding bill with sky. I moved over from sky to virgin around 3 years ago. Some time after that I started receiving contact saying I owed an outstanding amount to sky of around £600 which I absolutely dispute. Needless to say I was stupid and ignored the letters.

    Recently TM legal have been contacting me and sent me a letter of claim. The letter of claim form was all messed up with no option C&D in section one. I completed this as best I could stating I didn't not recognise the debt and requested the below documents which we're already listed. So I ticked each one. I also explained In my response the the letter of claim was messed up and difficult to understand. Anyway I sent this off recorded delivery.

    A week or so I received a reply saying the account was on hold until they provide me with the requested documentation. I then recieved another letter of claim form in the exact same format. Sections missing and all jumbled up. I responded with the same and also attached a letter to it. Explaining I had previously responded and the issues with the claim form. Again recorded delivery

    Not long after I recieved a letter saying the hold had been removed. And if I dont pay by the 13th of October a claim will be issued. Unfortunately ive misplaced this letter but hopefully ill find it. Anyway I ignored this as I hadn't been provided my requested document.

    Then low and behold first thing this morning on the 13th I get an email saying CCJ has been issued against me as I haven't responded. I haven't received a letter with the court papers as yet.

    I will try to upload the information I have recieved so far with my personal information removed. I am not sure where I stand with this as I followed what I believed I should have. Completed their form but I didn't receive the documents I requested. How can they make a claim? Any help would be much appreciated.

    Hi - You will have received a CCJ because you believed their false promise to supply documents, this is a common problem and these companies must not be trusted, but at the same time you must be organised and keep all letters etc. Them not supplying documents is rarely sufficient to cease a claim being issued. It sounds as if you received one or two pre-action letters however, it is common for companies to apply a temporary hold but still go ahead.
    Did you a Claim Pack at all? It would have been a bundle of papers with a court seal on the top.
    If you absolutely did NOT receive the pack then you can apply to set aside, please read our guide on this.
    If you did receive it or lost it, you have 30 days to pay the amount on the CCJ - if you do so, no CCJ will be recorded to your credit file.

        Hi thank you for taking the time to reply. I recieved the county court letter this morning.

        What are my options as I genuinely do not know if I owe this money and as they have not provided me with the requested documentation I dont know what to do.

        Does the letter they provided me have any value as the ketter states they would hold the case until the documentation is provided.

        I dont want to pay a debt that I dont know I owe.

          I might be wrong, but I don't think you have received a CCJ yet.

          What you've received is a Court Claim which you can Defend.

          Log onto MCOL, hopefully that will provide more details. Then update the thread.

          The photo you uploaded has conflicting information.

                Just the nonsense they've stated regarding the CCJ. The only way you get a CCJ is if you ignore a Judgement from the Court.
                You are a long way from a CCJ.

                I can't tell you if you've got enough information to Defend the claim, but they've lodged a claim. You state that you dispute it, so it makes sense to Defend it, get more information. At some point you'll have Mediation, but also more information on their claim.

                a) First Acknowledge service of the Claim, you can do this online via MCOL, this will give you 28 days (plus 5 days postal) in total to work on your defence.

                b) Send a SAR request to Sky, they have 30 days to provide all the data they hold on the account. Make sure you get Proof of Postage.

                d) Send a CPR 31.14 request to TM Legal, they have 7 days to provide all the documents they are relying on to make the claim against you, again get Proof of Postage. (Sky's agreement isn't covered by the Consumer Credit Act 1974, so no point in stating it in your request)

                e) This is an example Defence, start looking at it, don't fill or file it with the Court or their solicitors yet.

                Update the thread as you get information through.

                Don't speak to creditors, solicitors etc over the phone, everything in writing. Keep on top of this, especially dates for filing defence etc. Workout when your Defence is due, 28 days from the date on the claim form. If you can post on the thread 5 days before it's due we can help with your Defence.
