    I have received a claim form, but did not receive a Letter before action/pre action letter.

    They have added the following:

    £204 interest
    £118 court Fee
    £80 legal cost
    £402 in Total

    I called them this morning to say i am happy to pay the debt owed minus the fees added above as there was no pre action letter received and as per a previous letter in the year before we called staright away to set up a payment plan.

    They are now saying the following:

    Must pay in full to avoid CCJ and the defaults being marked as satisfied
    If i only pay the debt and not the fees that have been added then they will only mark the defaults as partially satisfied.

    Is this true, is there anything I can say or do to get them to drop all of the fees they have added including the interest or do i have to pay it all in order to avoid the CCJ and to have the defaults marked as satisfied?

    Also is there anything I can do to get the defaults removed following settlement?

    They've issued a claim.

    So you need to acknowledge service, that can be done online, you get an extra 14 plus 5 days to file your defence.

    You haven't received a letter before action, so Overdales / Lowells aren't following CPR Rules, you can use that in your defence.
