CCJ claim from lowell

    ok so i put in a witness statement to the courts a few days ago then yesterday i got email off overdales solicitors who are representing them stating Notice of discontinuance.

    so they have give up on the case and admitted they dont have required documents/evidence to enforce this dedt,i would assume they can no longer come back to court with this case.

    do i need todo anything from this point or is it finally over?

    again thank you all for your help without this forum it would not be possible for me to defend this case

    i will certainly make a donation to help you keep this site going for future people in need of help

      You assume wrong, if they find the documents they can apply to the court to reactivate the claim. However, the chances of that happening are slim.

      Await a copy of the NoD from the court stamped with the court seal and I would advise you to scan all the documents then save them to two cloud storage places. That way if one is corrupted or lost there's a backup.

      It ensures you have everything because debt purchasers have been known to sell unenforceable debts on to another purchaser who doesn't know about the claim. They're charming people who own these businesses, but then if someone else comes after you for it you can show that a claim has already been brought and discontinued, so they're barking up the wrong tree.

      Acknowledge Claim - within 14 days from Service

      Defend Claim - within 28 days from Service (IF you acknowledged in time)

      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
