TM Legal Services Limited Claim - Need Your Recommendation

    Asset & TM Legal are now below the bottom of the barrell.

    Actions include. Trying to threaten defendants with court action despite losing previous cases due to striking out because of their failure to comply with judges orders.

    They really are scum.

      I sent a CCA & CPR Request as recommended.

      I only received e-mail documents from Uncle Buck - the original lender

      No correspondence has been received since I filed the request to
      TM Legal & Asset Collections until today when I received this email.

      I didn't file my defense because I was waiting on them to provide
      the documents

            Well I got the mediation forms in last week. Just wondering what steps I should take next here ?

            Fill in the N180 Form or use the Government mediation service ?

                    I would suggest you communicate to them only in writing should you wish to.

                    The problem you have is by calling them up & asking for an agreement to stop the process you have acknowledged a debt.

                    I would mediate via the court process (not via TMs request) & demand (via the courts mediation process) thatTM provide the agreements & debt assignment notices to prove they have a legitimate claim on the debt.

                    You will be invited by the court to mediate & you will receive this in writing from the court & I would suggest you say yes on the basis that TM supply you with the assignment notices to prove Asset Collections now own the debt.

                      I've had a recent run in with this company issuing a claim against me. Defend it all the way. Head over to Consumer Action Group forums in their Debt section and there's plenty of help, letter templates, etc for you.

                      They didnt even turn up to court or submit any evidence so their claim was dismissed. It seems this is the experience of many who have chosen to defend. I personally think that they issue claims in the hope that it scares you into paying as most of their claims with fall apart in front of a judge if you submit a half decent defence / witness statement.

                        Say yes to mediation on that, and then if they did happen to come up with the relevant documents you have mediation, if they don't you cancel it.

                        Just for ref court mediation isn't talking to the claimant directly, it's a third party who acts as mediator by phone and calls one, then passes a message to the other, and vice versa until you reach an impasse or an agreement.

                        Burnck, I think Cynicalism is past template letters and whatnot as we're at Directions Q's and mediation... so all that has been done, but nice thought.

                          Sounds like "Uncle Buck" are up to their old tricks again.

                          Wasn't this payday loan shark company on TV recently for using bullying and intimidating tactics to get people to pay up, or face going to court and a CCJ?

                              I did as requested and actually received an order saying the Claimant failed to file the Directions Questionnaire with the CCBC
                              by the date of the specified Notice. If the Claimant does not comply with this order their claim will automatically be struck out
                              without further order of the Court.

                              This was on the 8th of April.... I've yet to hear or recieve anything since then,
