  • NEW MONEY CLAIM FORMS / MCOL / HMCTS / Court Claim

    The Court Service are currently trialling a new version of the MoneyClaim online system. The claim forms that are sent out look rather different to the old blue forms. We're working on a guide to dealing with claims that are issued through the new system with examples of the documents you may receive.

    If you are at all concerned if a claim you have received is genuine, please contact the Court where the claim has been issued or try to log in on the Moneyclaim website with the details given on the claim form.

    To Respond to a claim issued through the new system you should go to

    This then takes you to page where you can enter your claim number

    IF the claim is on the new system it will take you to the next page, however if your claim was initially brought through the old system it will take you to the old Moneyclaims.gov.uk homepage.

          First Draft for Claimants.... working on Defendants now.... I have kept it simple, as it is simple .... too simple IMO.... not sure how much I should push home the ' don't do this on a whim it's a legal claim and has consequences ' point... I can see some utterly awful claims coming through.

          This is just to show people the process, it's not a full guide for claimants for bringing a court claim....

                I'm wondering whether somewhere in the background they have changed the CPR or got some specific CPR for these new claims.... the first claim we've actually gone through to a hearing with that was brought on the new system ended up with the Judge saying that case law didn't apply in 'this kind of court' …. plus the Acknowledgement of Service part of the new system doesn't even mention 'Acknowledgement' just asks if you want an extra 14 days... have they simply over dumbed it down ? or have they invented some kind of new Judge Judy type court without actually telling anyone ?

                The claimant has to list documents …. can you still ask for those documents under CPR 31.14 or something else?

                or am I just not liking change? lol

                  I would have thought the reason the process/forms were changed was so all of these payday loans cases were actually initiated at court with the full set of docs to substantiate their case. .

                  Imagine how much its costing the courts to deal with all this rubbish.pointless & then abandoned cases for £30? Its costing the courts money on the amount of abandoned claims.

                    I really think that judge got it completely wrong in that case Ame.

                    As far as I can gather, PD51R seems to be the appropriate rules on the new online system.

                    Paragraph 5A suggests the criteria which seems to fit with the initial list of questions you have to answer before filing a claim on the new site.

                      Thanks Rob - it's all very much aimed at settlement or "sent out of the online court" isn't it so basically as soon as it's defended and mediation fails it's back to 'normal' court.

                      Oscillations case is playing on my mind - the judgment was just wrong. We don't lose and I can't see anything we did wrong - I suppose as he said after, the judge just took against him. It's worrying for other cases on similar lines primarily because of the 'doesn't apply in this court' comment and I'd hate to send someone else in with a similar interfamilial dispute on similar grounds and see them lose too because we wrote it off as a narkey Judge.

                        That's the hope eventually - at the moment bulk issuers still use the original system - the preaction procedure for debt claims was meant to sort some of it out but it simply doesn't - if a debtor responds with anything other than settlement or "seeking advice" - they just bung a court claim in on day 30 - and of course as they discontinue or get settled before a court hearing majority of the time there's absolutely sod all consequence for them.

                          Yes that's true, although be careful there are also online county court pilots in selected areas and is by invitation only but not mandatory and I think you have to be legally represented to at least qualify - see CPR 51S

                          As for oscillation's case that is deeply worrying but I don't think we have heard back from him have we? He's not replied since giving us an update so we don't know the full details and his time is running out to appeal. Unfortunately, as you will know, there is no way of rescinding absurd decisions other than by way of appeal.
