  • Bw legal phone call

    Hi. Hope i have the right forum.
    I have just recived a call from BW LEGAL saying I owe £700 from an O2 account back in 2008 ... I told them I have never been with o2 but they said there is now a ccj against me and that they are taking me to court and sending bailiffs if I can't pay the 700. What do I do
    please.

    have you looked on your credit file for any entries? try clearscore noddle et see if anything listed especially CCJ

        You need to ring the County Court Business Centre on 0300 123 1056 and find out when the judgement was obtained, why you did not receive the claim form (what address was it sent to), the claim number and ask for a copy of the claim form.

        After that we'll need to look at set aside for the judgement.

              Hi I just tried that number but it's engaged ...can they tale me to court then??? I read on the internet people saying just ignore bw legal and they will eventually go away ???

                  They have already taken you to court and got a judgement. Hence why you need to ring the court.

                  The next steps they are talking about is enforcement via bailiffs.

                  I didn't see the time, they'll be gone for the day now and you'll need to ring tomorrow, you'll just have to persevere until you get through.

                    Sorry... correction *** just checked my credit file. Can't see anything for O2 £700 on there.

                      The ccj comes under CLOSED ACCOUNTS on my credit file. Does that make scence???

                        Are BW Legal acting for anyone or are they the owners of the debt? That your credit file says closed is likely to mean closed with O2 and sold on to a debt purchaser.

                        Send a SAR to O2 to see what this might be / evidence it is not yours depending on the response.

                        The letter BW have sent you - does it have the date of the judgment / a claim number on ? You do need to give court a call ( they close at 4 so will have to be tmw ) to get the claim form and confirmation of the judgment.
                        If it is recent ( within the last month or so ) it may not show on your credit file or the ccj register as yet.
                        Otherwise it could be mistaken ID in tracing the actual person with the O2 account and CCJ - but you need to ask for a copy of the claim first - then you can consider whether to ask consent to have it set aside.
